ORDINANCE NO. 2011- 21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, CONCERNING 1.9 ACRES, MORE OR LESS, OF LAND IN THE PARK ADDITION, THIRD DIVISION SUBDIVISION LOCATED AT 817, 833 AND 907 CHESTNUT STREET; AMENDING THE FUTURE LAND USE MAP OF THE CITY FROM "NC" NEIGHBORHOOD COMMERCIAL AT 817 AND 833 CHESTNUT STREET AND FROM "LDR" LOW DENSITY RESIDENTIAL AT 907 CHESTNUT STREET TO " "MU" MIXED USE; AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING 817 AND 833 CHESTNUT STREET FROM "NC" NEIGHBORHOOD COMMERCIAL DISTRICT, 907 CHESTNUT STREET FROM "MF -12" MULTIPLE - FAMILY RESIDENTIAL DISTRICT AND THE REMAINDER OF SAID 1.9 ACRES, MORE OR LESS, TO "PDD" PLANNED DEVELOPMENT DISTRICT WITH BASE ZONING OF "MU" MIXED USE; APPROVING PLANNED DEVELOPMENT DISTRICT STANDARDS FOR THE CHESTNUT STREET LOFTS PLANNED DEVELOPMENT DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On April 12, 2011, the City Planning and Zoning Commission of the City of San Marcos held public hearings concerning 1.9 acres, more or less of land in the Park Addition, Third Division Subdivision located at 817, 833 and 907 Chestnut Street as more fully described in the attached Exhibit "A" (the "Project Site ") as follows: (a) regarding a request to change the Future Land Use Map of the San Marcos Horizons City Master Plan from "C" Commercial to "MU" Mixed Use for 1.387 acres, more or less, of the Project Site at 817 and 833 Chestnut Street as shown in Exhibit "A" ( "Tract A "); (b) regarding a request to change the Future Land Use Map of the San Marcos Horizons City Master Plan from "LDR" Low Density Residential to "MU" Mixed Use for 0.36 acres, more or less, of the Project Site at 907 Chestnut Street, identified as Lot 108 in Exhibit "A" ( "Tract B "); and (c) regarding a request to change the zoning for Tract A from "NC" Neighborhood Commercial District and the zoning for Tract B from "MF -12" Multiple - Family Residential District and the remainder of the Project Site to 'PDD" Planned Development District, with base zoning of "MU" Mixed Use. 2. Subsequent to the public hearings on such date, the Planning and Zoning Commission, on April 26, 2011 considered and voted to approve the requests, and has recommended that the requests be approved by the City Council of the City of San Marcos.
