ORDINANCE NO. 2011- 21 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, CONCERNING 1.9 ACRES, MORE OR LESS, OF <br />LAND IN THE PARK ADDITION, THIRD DIVISION SUBDIVISION <br />LOCATED AT 817, 833 AND 907 CHESTNUT STREET; AMENDING <br />THE FUTURE LAND USE MAP OF THE CITY FROM "NC" <br />NEIGHBORHOOD COMMERCIAL AT 817 AND 833 CHESTNUT <br />STREET AND FROM "LDR" LOW DENSITY RESIDENTIAL AT 907 <br />CHESTNUT STREET TO " "MU" MIXED USE; AMENDING THE <br />OFFICIAL ZONING MAP OF THE CITY BY REZONING 817 AND 833 <br />CHESTNUT STREET FROM "NC" NEIGHBORHOOD COMMERCIAL <br />DISTRICT, 907 CHESTNUT STREET FROM "MF -12" MULTIPLE - <br />FAMILY RESIDENTIAL DISTRICT AND THE REMAINDER OF SAID <br />1.9 ACRES, MORE OR LESS, TO "PDD" PLANNED DEVELOPMENT <br />DISTRICT WITH BASE ZONING OF "MU" MIXED USE; APPROVING <br />PLANNED DEVELOPMENT DISTRICT STANDARDS FOR THE <br />CHESTNUT STREET LOFTS PLANNED DEVELOPMENT DISTRICT; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />RECITALS: <br />1. On April 12, 2011, the City Planning and Zoning Commission of the City of San <br />Marcos held public hearings concerning 1.9 acres, more or less of land in the Park Addition, <br />Third Division Subdivision located at 817, 833 and 907 Chestnut Street as more fully described <br />in the attached Exhibit "A" (the "Project Site ") as follows: <br />(a) regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "C" Commercial to "MU" Mixed Use for 1.387 acres, <br />more or less, of the Project Site at 817 and 833 Chestnut Street as shown in Exhibit "A" <br />( "Tract A "); <br />(b) regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "LDR" Low Density Residential to "MU" Mixed Use <br />for 0.36 acres, more or less, of the Project Site at 907 Chestnut Street, identified as Lot <br />108 in Exhibit "A" ( "Tract B "); and <br />(c) regarding a request to change the zoning for Tract A from "NC" <br />Neighborhood Commercial District and the zoning for Tract B from "MF -12" Multiple - <br />Family Residential District and the remainder of the Project Site to 'PDD" Planned <br />Development District, with base zoning of "MU" Mixed Use. <br />2. Subsequent to the public hearings on such date, the Planning and Zoning <br />Commission, on April 26, 2011 considered and voted to approve the requests, and has <br />recommended that the requests be approved by the City Council of the City of San Marcos. <br />
