ORDINANCE NO 2005- 20 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.2289 ACRE TRACT OF PROPERTY LOCATED AT 602 WEST HOPKINS STREET FROM "MF-4" MULTI-FAMILY DISTRICT (HIGH DENSITY) TO "OP" OFFICE PROFESSIONAL DISTRICT, INCLUDING PROCEDURAL PROVISIONS, AND PROVIDING FOR PENALTIES 1 On November 23, 2004, the PlannIng and ZOnIng CommissiOn of the CIty of San Marcos held a publIc heanng regardmg a request to change the ZOnIng from "MF -4" MultI-FamIly Dlstnct (High DensIty) to "LB" LImIted Busmess Dlstnct for a 0.2289 acre tract of property located at 602 West Hopkms Street. 2 Subsequent to the publIc heanng on that date, the Planmng and Zomng CommISSiOn dId, on November 23, 2004, conSIder and vote to approve the request, and has recommended that the request bc approved by the CIty CouncIl of the CIty I 3 The CIty CouncIl adopted a new Land Development Code (the "LDC") on December 13,2004, and the LDC contams new zomng dlstnct desIgnatiOns, and the new ZOnIng dlstnct m the LDC that IS most sImIlar to "LB" LImIted Busmess Dlstnct, and permIts the use contemplated by the applIcant for thIS rezonmg, IS "OP" Office ProfessiOnal Dlstnct. 4 March The CIty CouncIl held a publIc heanng on the 1st ,2005, regardmg the request. day of 5 All requIrements of Chapter 114, Zomng, of the San Marcos CIty Code and Chapters 1 and 4 of the San Marcos Land Development Code pertaining to zomng map amendments have been met. 6 The CIty CouncIl hereby finds and determmes that the adoptiOn of the followmg ordmance IS m the mterest of the publIc health, morals, welfare and safety BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS I SECTION 1 The OffiCIal Zonmg Map of the CIty, as descnbed m SectiOn 114 029 of the San Marcos CIty Code, IS amended to rezone the followmg real property whIch IS presently zoned "MF-4" MultI-FamIly Dlstnct (High DenSIty) to "OP" Office ProfeSSiOnal Dlstnct.
