<br />91. <br /> <br />RESOLUTION 2000 - 6 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING THE EXCHANGE OF <br />CITY PROPERTY WITH W. C. CARSON AND WITH BRIAN <br />MCCOY AND WETONNAH MCCOY; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE DEEDS; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City is the current owner of Tracts #3, #4 and #8 as shown on the attached diagram and <br />analysis. W.C. Carson is the owner of Tracts #1 and #5. Brian McCoy and Wetonnah McCoy (the <br />"McCoys") are the owners of Tracts #2 and #6. All of this property is located within the site of the <br />former Lowman Airport. <br /> <br />2. Mr. Carson and the McCoys have requested an exchange of properties among themselves, <br />between the City and Mr. Carson, and between the City and the McCoys, all as described on the <br />attached analysis, to provide right-of-way access to their property. <br /> <br />3. The City-owned tracts of property to be exchanged cannot be used independently because of <br />their shape and small area, and the property is therefore eligible under TEX. LOCAL Goy'r CODE <br />ANN. ~272.001(b)(1) and (3) for sale to Mr. Carson and the McCoys for its fair market value as <br />determined by an appraisal obtained by the City. <br /> <br />4. The City's Tract # 4 and #8 will be exchanged 'for Mr. Carson's Tract #5, and the City's Tract <br />#3 will be exchanged for the McCoys' Tract #6, with payments to the City of$9,827 to be made by <br />the McCoys and $23,310 to be made by Mr. Carson. <br /> <br />5. The City has complied with the requirements of TEX. LOCAL Goy'r CODE ANN. <br />~272.001(b)(1) and (3) regarding the sale of surplus real property. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />P ART 1. The exchanges of real property described in Recital 4 above for the exchange <br />of real property are approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is auth_orized to execute and deliver <br />special warranty deeds for the exchanges of property described in Recital 4 above upon payment to <br />the City of the amounts stated in Recital 4 by the respective parties. <br /> <br />PART 3. <br /> <br />This Resolution is in full force and effect from and after its passage. <br /> <br />ADOPTED on <br /> <br />January 24 <br /> <br />,2000. <br /> <br />f)~ ~ ~ <br /> <br />Billy G.
