<br />I <br /> <br />I <br /> <br />I <br /> <br />10. <br /> <br />RESOLUTION NO. 2006 - <br /> <br />5 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING FIVE PIPELINE <br />CROSSING AGREEMENTS BETWEEN THE CITY AND UNION <br />PACIFIC RAILROAD COMPANY RELATED TO THE <br />RIVERSIDE-MKT WASTEWATER INTERCEPTOR PROJECT; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENTS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The Union Pacific Railroad Company (the "Railroad") owns right-of-way located <br />within the City which will be crossed by the Riverside-MKT Wastewater Interceptor Project (the <br />"Project"). <br /> <br />2. The execution ofthe five attached Pipeline Crossing Agreements with the Railroad is <br />necessary for the Project to cross the Railroad right-of-way. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />P ART 1. The five attached Pipeline Crossing Agreements between the City and Union <br />Pacific Railroad Company are approved. <br /> <br />PART 2.
