<br />I <br /> <br />I <br /> <br />I <br /> <br />52. <br /> <br />RESOLUTION 2006- 1 3 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE CITY'S CONTRIBUTION OF $140,006.75 IN <br />ADDITIONAL FUNDS TO THE WONDER WORLD DRIVE RAILROAD <br />OVERPASS PROJECT FOR THE ADDITION OF SIDEWALKS; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE TEXAS <br />DEPARTMENT OF TRANSPORTATION CHANGE ORDER NUMBER 5 ON <br />BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On January 12, 2004, the City approved an Advance Funding Agreement <br />between the City and the Texas Department of Transportation ("TxDOT") for the Wonder <br />World Drive (FM3407) Railroad Overpass Project (the "Project"). <br /> <br />2. On February 11, 2002 the City approved an Agreement to Contribute Funds <br />with TxDOT for additional funding for the cost of State right-of-way acquisition and eligible <br />utility adjustments. <br /> <br />3. In the fall of 2005, the City requested the addition of sidewalks to the Project. <br /> <br />4. The State requires that the City execute the change order issued for the <br />Project between TxDOT and Hunter Industries, Ltd. committing to the additional funding <br />necessary for this change. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. The City's contribution of an additional $140,006.75 in funding for the <br />addition of sidewalks to the Project is approved as evidenced in Change Order Number 5, <br />a copy of which is attached to this Resolution. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute TxDOT <br />Change Order Number 5 on behalf of the City. <br /> <br />PART 3. This Resolution shall be in full force and effect immediately from and <br />after its passage. <br /> <br />ADOPTED this the 17th <br /> <br />day of January, <br /> <br />2006. <br /> <br />
