<br />I <br /> <br />I <br /> <br />I <br /> <br />100. <br /> <br />RESOLUTION 2006- 22 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING AN EMERGENCY CONSTRUCTION CONTRACT WITH <br />DU-MOR ENTERPRISES, INe. FOR THE HOPKINS STREET EMERGENCY <br />RAILROAD CROSSING WATER LINE PROJECT; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THE CONTRACT DOCUMENTS ON BEHALF OF <br />THE CITY; AND DECLARING AN EFFECTNE DATE. <br /> <br />RECITALS: <br /> <br />1. On January 20, 2006, a ten inch diameter water main ruptured under the UnionPacitic <br />Railroad Tracks on Hopkins Street which impacts the tire flow capacity for commercial and retail <br />shopping areas adjacent to the main break. <br /> <br />2. The City wishes to engage Du-Mor Enterprises, Inc. for the necessary work due to <br />its immediate availability and extensive experience in the work needed for this water hne repair. <br /> <br />3. The City Council tinds and determines that it is necessary to enter into this <br />construction contract on an emergency basis without formal competitive bidding in order to preserve <br />and protect the public health and safety of the City's residents. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The award of an emergency contract to Du-Mor Enterprises, Inc. for the <br />Hopkins Street Emergency Railroad Crossing Water Line Project in the amount of$101,747.50 is <br />approved. <br /> <br />PART 2.
