ORDINANCE NO. 2003- 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE ABANDONMENT OF A PORTION OF THE ALLEYWAY BETWEEN THE 1200 BLOCKS OF MARLTON STREET AND EARLE STREET; APPROVING THE CONVEYANCE OF THIS PORTION OF THE ALLEYWAY TO ALBADALANA DANIEL AND NAWONA CRENWELGE; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; AND DECLARING AN EFFECTIVE DATE. 52. RECITALS: 1. On November 12, 2002, the City Planning and Zoning Commission conducted a public hearing on the proposed abandonment of a portion of the alleyway between the 1200 Blocks of Marlton Street and Earle Street, and voted to approve the proposal. 2. The City Council conducted a pubtic hearing regarding this abandonment on January 13. , 2003. 4. All requirements of Chapter 74, Streets and Sidewalks, of the San Marcos City Code pertaining to alley abandonments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The abandonment of the portion of the alleyway between the 1200 Blocks of Marlton Street and Earle Street, as depicted on the attached map, is approved. SECTION 2. The City Manager, Dan O'Leary, is authorized to execute the Quitclaim Deed attached to this ordinance conveying to Albadalana Daniel and Nawona Crenwelge the alleyway described above, without cash consideration. SECTION 3. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
