ORDINANCE NO. 2003- 7 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE ABANDONMENT OF A PORTION OF <br />THE ALLEYWAY BETWEEN THE 1200 BLOCKS OF MARLTON STREET <br />AND EARLE STREET; APPROVING THE CONVEYANCE OF THIS <br />PORTION OF THE ALLEYWAY TO ALBADALANA DANIEL AND NAWONA <br />CRENWELGE; AUTHORIZING THE CITY MANAGER TO EXECUTE A <br />DEED; AND DECLARING AN EFFECTIVE DATE. <br /> <br />52. <br /> <br />RECITALS: <br /> <br /> 1. On November 12, 2002, the City Planning and Zoning Commission <br />conducted a public hearing on the proposed abandonment of a portion of the alleyway <br />between the 1200 Blocks of Marlton Street and Earle Street, and voted to approve the <br />proposal. <br /> <br /> 2. The City Council conducted a pubtic hearing regarding this abandonment on <br />January 13. , 2003. <br /> <br /> 4. All requirements of Chapter 74, Streets and Sidewalks, of the San Marcos City <br />Code pertaining to alley abandonments have been met. <br /> <br /> 5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. The abandonment of the portion of the alleyway between the 1200 <br />Blocks of Marlton Street and Earle Street, as depicted on the attached map, is approved. <br /> <br /> SECTION 2. The City Manager, Dan O'Leary, is authorized to execute the <br />Quitclaim Deed attached to this ordinance conveying to Albadalana Daniel and Nawona <br />Crenwelge the alleyway described above, without cash consideration. <br /> <br /> SECTION 3. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Secretary will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading January ].3, 2003. <br /> <br />PASSED AND APPROVED on second reading JANUARY 27, 2003, <br /> <br />PASSED, APPROVED AND ADOPTED February 10, 2003. <br /> <br />Published in San Marcos Daily Record or Friday, February 14, 2003. <br /> <br /> <br />
