<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, APPROVING THE PRICE
<br />AND CONDITIONS OF THE SALE BY THE CITY OF
<br />SAN MARCOS, TEXAS, OF LOTS NINE (9) AND TEN
<br />(10) OF BLOCK THIRTY THREE (33) IN VICTORY
<br />GARDENS SECTION TWO (2) IN SAID CITY TO
<br />DANIEL AGUILAR, SR.; AUTHORIZING THE MAYOR
<br />TO EXECUTE A WARRANTY DEED TO DANIEL AGUILAR,
<br />SR. AND DECLARING AN EMERGENCY.
<br />
<br />WHEFBAS, the City of San Marcos, Texas, advertised for
<br />bids for the sale of Lots Nine (9) and Ten (10) of Block Thirty
<br />Three (33) in the Victory Gardens Section Two (2), a subdivision
<br />located in said City and in Hays County, Texas, also known as
<br />Urban Renewal Parcel No. 44R-5 & 6, in the San Marcos Record,
<br />a local newspaper with a general circulation in the County of
<br />Hays, State of Texas, on August 23, 1981, and August 30, 1981;
<br />and,
<br />
<br />WHEREAS, pursuant to said advertisement a bid was submitted
<br />by Daniel Aguilar, Sr., for said described property in the amount
<br />of Three Thousand Dollars ($3,000.00); and,
<br />
<br />WHEREAS, said bid met the minimum disposition price set
<br />for said property by the Urban Renewal Board of Commissioners
<br />of the City of San Marcos, Texas~-on September 15, 1981; and,
<br />
<br />WHEREAS, said Board accepted the bid as the highest and
<br />best responsible bid for said property on September 15, 1981;
<br />and,
<br />
<br />WHEREAS, said Board recommends the approval of said purchase
<br />price and the approval of the terms and conditions for said sale,
<br />as contained in the bid document; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:

<br />SECTION 1. That the terms and conditions of the sale by the
<br />City of San Marcos, Texas, of all of Lots Nine (9) and Ten (10)
<br />in Block Thirty-Three (33) in the Second Section of Victory Gardens,
<br />a subdivision in Hays County, Texas, according to the map or
<br />plat thereof, recorded in Volume 130, Pages 48-52 of the Deed Rec-
<br />ords of Hays County, Texas, also known as Urban Renewal Parcel
<br />No. 44R-5 & 6, to Daniel Aguilar, Sr. are hereby approved.
<br />
<br />SECTION 2. That the consideration of Three Thousand Dollars
<br />($3,000.00) for said property be, and the same is hereby, approved.
<br />
<br />SECTION 3. That the purchaser is hereby placed on notice
<br />that the subject property is subject to assessment under the
<br />provisions of Article 1105b, Texas Revised Civil Statutes.
<br />
<br />SECTION 4. That the mayor of the City of San Marcos, Texas,
<br />Emmie Craddock be, and she is hereby, authorized to execute a
<br />warranty deed to Daniel Aguilar, Sr., of Hays, County, Texas,
<br />from the City of San Marcos, for said property.
<br />
<br />SECTION 5. That the importance of this Ordinance creates
<br />an emergency and an imperative purpose necessary that the provisions
<br />of the charter requiring that ordinances shall be read on three
<br />separate meetings and that no ordinance shall become effective un-
<br />til the expiration of ten (10) days following the date of its
<br />final passage be suspended, and these provisions are hereby suspended
<br />and this Ordinance shall take effect and be in full force and
<br />effect from and after its adoption and publication in a newspaper
<br />
