109 RESOLUTION NO. 1982-15~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TEill1S AND CONDITIONS OF A LICENSE AGREE- MENT BETWEEN SAID CITY AND THE MISSOURI PACIFIC RAILROAD COMPANY FOR PROPOSED STORM DRAINAGE IMPROVEMENTS IN SAID CITY; AUTHORIZING THE MAYOR OF SAID CITY TO EXE- CUTE SAID AGREEMENT ON BEHALF OF SAID CITY AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas, desires permis- sion for the construction of a 24-inch storm drain line un- der the railroad tracks at Truman Street within the City of San Marcos, the purpose of said construction being improve- ment to an existing drainage ditch along the right-of-way of the Missouri Pacific Railroad Company; and, WHEREAS, it is necessary to obtain a license from said railroad company approving said placement; and, WHEREAS, said railroad company is agreeable to granting such a license on the terms and conditions of the attached Agreement; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions of the Agreement between the City of San Marcos, Texas, and the Missouri Pacific Railroad Company concerning a license to said City for the construction of a 24-inch storm drain line under the railroad tracks at Truman Street in said City, a copy of which Agreement is attached hereto and incorporated herein for all intents and purposes, be, and the same are hereby, approved in all respects. PART 2. That the Mayor of the city of San Marcos, Texas, be, and she is hereby, authorized to execute said Agreement on behalf of the City of San Marcos. PART 3.
