<br />RESOLUTION NO.1982-22R

<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AUTHORIZING FINAL PAY-
<br />MENT TO PRO-TECH ENGINEERING GROUP, INC., FOR
<br />ENGINEERING SERVICES CONNECTED WITH THE VIC-
<br />TORY GARDENS PHASE III IMPROVEMENTS AND
<br />DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />approved by resolution duly adopted September 22, 1980, the
<br />employment of Pro-Tech Engineering Group, Inc., of San Marcos,
<br />Texas, for provision of engineering services connected with
<br />street paving, drainage, utility and sidewalk improvements on
<br />Eisenhower, Georgia, Arizona and Valley Streets within the
<br />corporate limits of said city, said improvements known as the
<br />Victory Gardens Phase III Improvements; and,
<br />
<br />WHEREAS, a contract between the City of San Marcos and pro-
<br />Tech Engineering Group, Inc., for payment for said services was
<br />executed on September 23, 1980; and,
<br />
<br />WHEREAS, the City of San Marcos has received a request from
<br />Pro-Tech Engineering Group, Inc. for payment in the amount of Two
<br />Thousand Five Hundred Thirteen Dollars and Thirty Two Cents
<br />($2,513.32), said payment to be the final payment for said
<br />services, said payment consisting of Two Thousand One Hundred
<br />Thirty Dollars and Eighty Two cents ($2,130.82) due for Basic
<br />Services and Three Hundred Eighty Two Dollars and Fifty Cents
<br />($382.50) for Additional Services; and,
<br />
<br />WHEREAS, Public Works Administrator Daniel Brown has found
<br />said engineering services to have been satisfactorily completed
<br />pursuant to the terms of said contract and has recommended said
<br />final payment; and,
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />hereby finds and determines on the basis of said recommendation
<br />that there has been substantial compliance with the terms of the
<br />contract of September 23, 1980, between said City and Pro-Tech
<br />Engineering Group, Inc.; now, therefore,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:
<br />
<br />PART 1. That payment in the amount of Two Thousand Five
<br />Hundred Thirteen Dollars and Thirty Two Cents ($2,513.32) is
<br />hereby authorized as final payment for all services connected
<br />with the provision of engineering services pursuant to the terms
<br />of that contract of September 23, 1980, between the City of San
<br />Marcos, Texas, and Pro-Tech Engineering Group, Inc., concerning
<br />the Victory Gardens Phase III Improvements.
<br />
<br />PART 2. That said final payment shall be made to Pro-Tech
<br />Engineering Group, Inc., of San Marcos, Texas.
<br />
<br />PART 3. That this Resolution shall become effective
<br />immediately from and after its passage.
<br />
