<br />
<br />A RESOLUTION OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, ACCEPTING THAT
<br />PROJECT KNOWN AS THE BISHOP STREET SANITARY
<br />SEWER EXTENSION PROJECT FOR USE BY SAID CITY;
<br />AUTHORIZING FINAL PAYMENT IN THE AMOUNT OF
<br />$27,439.62 TO DU-MOR ENTERPRISES OF SAN MAR-
<br />COS, TEXAS, FOR CONSTRUCTION OF SAID SANITARY
<br />SEWER EXTENSION AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the City of San Marcos, Texas, on January 20,
<br />1982, contracted with Du-Mor Enterprises, of San Marcos,
<br />Texas, for construction of a sanitary sewer extension on
<br />Bishop Street within said City; and,
<br />
<br />WHEREAS, the original contract amount was $41,350.00;
<br />
<br />and,
<br />
<br />WHEREAS, said contract amount was subsequently in-
<br />creased by $2,631.62, for a revised contract amount of
<br />$43,981.62; and,
<br />
<br />WHEREAS, previous payments have been made by said City
<br />to Du-Mor Enterprises, said payments of a total amount of
<br />$16,542.00; and,
<br />
<br />WHEREAS, on May 6, 1982, by written request to said
<br />City, John E. Harris, Jr., Du-Mor Enterprises superinten-
<br />dent for said project, requested final inspection of and
<br />final payment for said construction work on said project;
<br />and,
<br />
<br />WHEREAS, final inspection on said Bishop Street sani-
<br />tary sewer extension project was conducted on May 10, 1982,
<br />by George Boeker, Director of Public Works, and Wayne T.
<br />Henderson, Public Works Inspector; and,
<br />
<br />WHEREAS, said construction work was found to be in sub-
<br />stantial compliance with the terms and conditions of that
<br />contract between the City of San Marcos and Du-Mor Enter-
<br />prises for the Bishop Street Sanitary Sewer Extension Pro-
<br />ject entered into January 20, 1982; and,
<br />
<br />WHEREAS, George Boeker has recommended that final payment
<br />in the amount of $27,439.62 be made to Du-Mor Enterprises, of
<br />San Marcos, Texas; now, therefore,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:
<br />
<br />PART 1. That that project known as the Bishop Street Sani-
<br />tary Sewer Extension Project be accepted for use by the City
<br />of San Marcos as of the date of final inspection of said pro-
<br />ject, May 10, 1982.
<br />
<br />PART 2. That final payment in the amount of $27,439.62
<br />be made to Du-Mor Enterprises of San Marcos, Texas, for con-
<br />struction work on said project.
<br />
<br />PART 3. That this Resolution shall be in full force and
<br />effect from and after its passage.
<br />
<br />ADOPTED this 24th day of
