<br />79. <br /> <br />RESOLUTION 1999- 8 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF A TOWER RENTAL AGREEMENT <br />BETWEEN THE CITY AND WESTERN PCS BTA I <br />CORPORATION, FOR PLACEMENT OF ANTENNA <br />EQUIPMENT AT THE ALAMO STREET WATER TOWER <br />SITE; AUTHORIZING THE CITY MANAGER TO EXECUTE <br />THE AGREEMENT ON BEHALF OF THE CITY; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Western PCS BT A I Corporation ("Western") has requested a lease of space <br />at the City's Alamo Street Water Tower site for the installation of antenna equipment. <br /> <br />2. The City is willing to lease this space to Western under the terms and <br />conditions in the attached Tower Rental Agreement, subject to the approval of a specific <br />use permit for the installation by the City Planning and Zoning Commission. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The terms and conditions of the Tower Rental Agreement attached to <br />this Resolution between the City and Western are approved, subject to the approval of a <br />specific use permit for the installation by the City Planning and Zoning Commission. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute this <br />Agreement on behalf of the City, upon the approval of a specific use permit for the <br />installation by the City Planning and Zoning Commission. <br /> <br />PART 3. <br />passage. <br /> <br />This Resolution is in full force and effect immediately upon its <br /> <br />ADOPTED this 11th day of Januar,y1999. <br /> <br />~~~.~ <br /> <br />Billy G.
