I..I.J lL_ w~ << ,- - -. ta:i c::c fd~ CIJ_ ~; y;;;S 14 ORDINANCE 1999 - :l~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE ABANDONMENT OF THE ALLEYWAY ADJACENT TO LOT 1 A, BLOCK2 OF THE B.F. DONALDSON ADDITION LOCATED BETWEEN THAT LOT AND THE UNION PACIFIC RAILROAD RIGHT-OF-WAY; APPROVING THE CONVEYANCE OF THIS ALLEYWAY TO CAPITAL AREA RURAL TRANSPORTATION SYSTEM; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. On January 12, 1999, the City Planning and Zoning Commission conducted a public hearing on the proposed abandonment of the alleyway adjacent to Lot 1A, Block 2, B. F. Donaldson Addition located between that lot and the Union Pacific Railroad right- of-way, and voted unanimously to approve the proposal. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The abandonment of the alleyway adjacent to Lot 1 A, Block 2 of the B.F. Donaldson Addition is approved. SECTION 2. The City Manager, Larry D. Gilley, is authorized to execute the Quitclaim Deed attached to this ordinance conveying to Capital Area Rural Transportation Systems the alleyway described above, without cash consideration. SECTION 3. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
