<br />46 <br /> <br />ORDINANCE NO. 1980-7 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CIlY COUNCIL OF THE CIlY <br />OF SAN MARCOS, TEXAS, ACCEPTING THE BID OF <br />OF RUPERTO RIVEFA FOR THE PURrnASE OF LOTS <br />3 AND 4 OF BLOCK 15 OF THE VICTORY GARDENS <br />ADDITION # 1 TO 'mE CIlY OF SAN MARCOS, TEXAS,- <br />SAID ADDITION BEING RECORDED IN VOLUME 129 <br />AND PAGE 559 OF THE flAYS COUNTI DEED RECORDS, <br />AUIHORIZING THE MAYOR TO EXECUTE A SPECIAL <br />WARRANTI DEED TO SAID BIDDER ON BEHALF OF THE <br />CITI OF SAN MARCOS, ill TRUST, FOR ITSELF, THE <br />STATE OF TEXAS, 'mE COUN1Y OF HAYS, AND THE <br />SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL <br />DISTRICT; AND DEClARING AN EMERGENC'i. ~. <br /> <br />WHEREAS, the City of San Marcos acquired all that rig,ht, title and <br />interest conveyed by Sheriff's Deed, dated January 12, 1965, in and to <br />LDts 3 and 4 of block 15 of the Victory Gardens #l Addition to the City <br />of San Marcos, said addition recorded in Volume 129 and Page 559 of the <br />Hays COlmty Deed Records, as trustee for itself, the State of Texas, the <br />COlmty of Hays, and the San Marcos Consolidated Independant School <br />District; and, <br /> <br />WHEREAS, said lots were not redeemed by the former owners within <br />the statutory period; and, <br /> <br />WHEREAS, the City duly advertised said lots for sale in a newspaper <br />of general circulation on December 30, 1979 and January 2, 1980; and <br /> <br />WHEREAS, the bid by Ruperto Rivera, opened on January 8, 1980, was <br />the highest and best responsible bid; and, <br /> <br />I <br /> <br />WHEREAS, the bid by Ruperto Rivera is sufficient to pay the delinquent <br />taxes, penalty, interest and court costs due on said property and the legal <br />actions pursuant thereto; now, therefore, <br /> <br />BE IT ORDAINED BY THE CIlY COUNCIL OF THE CIlY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the bid of Ruperto Rivera in the arrount of three <br />thousand dollars ($3,000.00) for LDts 3 and 4 of Block 15 of the Victory <br />Gardens #1 Addition to the City of San Marcos, Texas, said addition being <br />recorded in Volume 129 Page 559 of the Hays County Deed Records, be, and <br />is hereby, accepted as the highest and best responsible bid. <br /> <br />SECTION 2. That the Mayor of the City of San Marcos, John A. Hansen, <br />or his successor, be, and is hereby, authorized to execute a special <br />waITanty deed to Ruperto Rivera for said property on behalf of the City of <br />San Marcos, in trust for itself, the State of Texas, the County of Hays, <br />and the San Marcos Consolidated Independent School District. <br /> <br />I <br /> <br />SECTION 3. That the importance of this Ordinance creates an emergency <br />an i.mperati ve purpose necessary that the provisions of the Charter requiring <br />all ordinances be read at three separate rreetings and that no ordinance shall <br />become effective until the expiration of 10 days following the date of its <br />final passage, be suspended, and this provision is hereby suspended, and <br />this Ordinance shall t:ake effect: and be in full force and effect: from and <br />after its adoption and publication in a newspaper of general circulation <br />within the City. <br /> <br />PASSED, APPROVED AND J\IX)PTED thi1~ day of I' ~ ' 19 8 () . <br /> <br /> <br />~n O,;~ <br />John A.
