<br />I <br /> <br />I <br /> <br />I <br /> <br />RESOLUTION NO. 1980-11 R <br /> <br />48 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THAT RESOLUTION <br />ADOPTED JANUARY 14, 1980, WHICH ORDERED THE <br />REGULAR CITY ELECTION TO BE HELD APRIL 5, 1980 <br />BY PROVIDING FOR THE ELECTION OF A COUNCIL MEMBER <br />FOR PLACE THREE; AND DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, a Resolution was adopted on January 14, 1980, which <br />ordered that the regular City election for election of City <br />officers be held Saturday, April 5, 1980; and <br /> <br />WHEREAS, Bob Hyatt, Council Member Place Three, has filed a <br />request to be placed on the City officer election ballot to <br />be considered as a candidate for Mayor, effective February 4, 1980; <br />and <br /> <br />WHEREAS, Article 11, Section 11, of the State Constitution <br />provides that a person holding a City office carrying a term <br />of more than two years automatically resigns from that office <br />if he becomes a candidate for any other office when the unexpired <br />term of the office held exceeds one year; and <br /> <br />WHEREAS, Bob Hyatt on February 4, 1980, did hold the office of <br />Council Member, said office carrying a term of three years and <br />expiring in April of 1981; and <br /> <br />WHEREAS, Mr. Hyatt has forfeited his office as Council Member <br />Place Three upon becoming a candidate for Mayor of the City of <br />San Marcos, Texas; and <br /> <br />WHEREAS, it is now necessary to fill the unexpired term for Council <br />Member Place Three by electing a person to serve until the regular <br />election to be held in April of 1981; <br /> <br />NOW, THEREFORE, be it resolved by the City Council of the City of <br />San Marcos, Texas: <br /> <br />PART 1. That the ballot for the regular City election to be held <br />Saturday, April 5, 1980, contain the following proposition for <br />election of a Council Member: <br /> <br />COUNCIL MEMBER, PLACE THREE (unexpired term). <br /> <br />PART 2.
