<br />The Mayor called the meeting to order at 8:00 p.m.
<br />
<br />Mr. Cavazos made a motion to bring the Ethics Ordinance off the table.
<br />Mr. Stokes seconded the motion which passed unanimously. The City
<br />Secretary read the caption of the Ordinance as follows:
<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS, DECLARING THE POLICY OF SAID CITY PERTAINING TO
<br />ETHICAL CONDUCT OF CITY OFFICIALS AND EMPLOYEES; DEFINING
<br />TERMS; ESTABLISHING STANDARDS OF CONDUCT FOR CITY OFFICERS
<br />AND EMPLOYEES; SETTING REQUIREMENTS FOR THE DISCLOSURE
<br />OF INTEREST IN DECISIONS PENDING BEFORE SAID OFFICERS AND
<br />EMPLOYEES; DESIGNATING PERSON TO WHOM DISCLOSURE SHALL BE
<br />MADE; REQUIRING A FINANCIAL DISCLOSURE STATEMENT FROM CERTAIN
<br />CITY OFFICIALS; DESIGNATING INFORMATION TO BE REPORTED ON SAID
<br />STATEMENT; SETTING PROCEDURES FOR RETENTION AND INSPECTION
<br />OF STATEMENTS. DESIGNATING PERSON TO PROMULGATE AND PROVIDE
<br />FORMS FOR STATEMENTS; ESTABLISHING AN ETHICS REVIEW COMMISSION;
<br />ESTABLISHING DUTIES OF SAID COMMISSION; SETTING PENALTIES;
<br />PROVIDING FOR SEVERABILITY AND ESTABLISHING AN EFFECTIVE DATE.

<br />Mr. Tenorio moved to make the following changes to Article I:
<br />Article I, Section 3, paragraph A, Subparagraph I-delete entirely.
<br />Renumber subparagraphs as follows: 2 to 1, 3 to 2, 4 to 3, 5 to 4.
<br />Article I, Section 3, paragraph A, subparagraph 2-add C to read as follows:
<br />"This is not meant to prohibit any person from accepting employment
<br />based on competitive application". Article I, Section 3, paragraph B-
<br />add subparagraph (5) to read as follows: "(5) No officer or employee
<br />shall be deprived of his/her right to due process under the law which
<br />would include the right to represent himself in a court proceeding". Mr.
<br />Cavazos seconded the motion which was approved unanimously. Mr. Tenorio
<br />made a motion to change Article II as follows: Article II, Financial
<br />Disclosure, Section 1. Definitions-Definition A. Candidate - delete.
<br />Reletter definitions as follows: B to A, C to B, D to C, E to D, F to E,
<br />G, to F, H to G, I to H, J to I, and K to J. Article II, Section 1.
<br />nefinitions Re-Letter Definition H to read as follows: "City Official:
<br />The Mayor, every member of the City Council, the City Manager, the City
<br />Attorney, the City Secretary and Judges of the Municipal Court. If the
<br />job title of City Manager, City Attorney, City Secretary, and Judges
<br />of the Municipal Court is changed, the term "city official" shall include
<br />the persons charged with the duties of the listed positions. Mr. Cavazos
<br />seconded the motion. On roll call, the following vote was recorded:
