Sutton <br /> <br />Also Present: Lannie Griffith, Gordon Thompson, Jerri Martin, Rey <br />Guevara-Vazquez, Tess Norris, Karl Brown, John Kreczmer, Melissa Millecam, <br />Sharyl Werner, Jake Krauskopf, Lee Mitchell, Ken Long, Bob Banta and others. <br /> <br />The Mayor called the meeting to order at 7:30 p.m. <br /> <br />The Mayor introduced for consideration discussion of proposed revision <br />of the Ethics Ordinance. Mr. Tenorio asked the City Attorney to explain <br />why she would not approve the Ordinance. The City Attorney stated her <br />three objections to the Ordinance. They are attached and made a part <br />of these minutes. Mr. Stokes asked her if she would be agreeable to <br />having another attorney come to City Hall to discuss her opinion. The <br />City Attorney said that the Council could ask for another opinion at <br />any time. She said that she, as City Attorney, could not request an <br />Attorney General's opinion. Mr. Tenorio said that third party rights <br />were a great concern. The City Attorney said to make something confidential, <br />it has to be by statute. She said the Review Commission felt that <br />candidates should not have to make as extensive a financial disclosure <br />statement as elected officials. Mr. Stokes said he took a poll of some <br />of the Boards and Commissions to see how many people would not serve <br />if they had to file a financial disclosure statement. He said he was <br />concerned at the number of people who said they would not serve. He said <br />it would be hard to draw a line at which Boards and Commissions~to~-~ncLude. <br />The City Attorney said that the Commission had reviewed each Board and <br />Commission individually to decide which ones should be covered. The Mayor <br />then asked if there were any citizens that had any recommendations concerning <br />the Ordinance. Karl Brown said he had some question about the elimination <br />of some of the Boards and Commissions from the Ordinance. He said that <br />anything the Council decides should be in harmony with state law. He said <br />that people who come in to look at the financial statements should have <br />to log in. Lee Mitchell said that the citizens had voted for an Ethics <br />Ordinance, but did not think that that was what they got. He said the <br />citizens needed to know about someone who is running for public office. <br />Mr. James stated that he felt that all the Boards and Commissions should <br />be covered by the Ordinance, but that they would be exempt from making a <br />disclosure of money amounts. He also felt that the candidates portion <br />should be included so that they would have to make a financial disclosure <br />statement. He also wanted the original inspection and retention portion <br />put back into the Ordinance and that all employees should be covered the <br />same as the Boards and Commissions. Mr. Breihan said he would like to <br />have a copy of Mr. James's recommendations. Mr. Stokes said the Review <br />Commission should have had a set of proposed rules and regulations along <br />with their proposed Ordinance and that until he saw these proposed rules <br />and regulations, he would not vote on any changes. Mr. Tenorio said that <br />he was prepared to wait for the new Council to make recommendations for <br />changes. He also stated that if any other Council members had suggestions <br />for changes, they should put them in writing and distribute them among <br />the other Council members. The City Secretary read a letter from Michael <br />J. Vivian concerning citizen interest in the Ordinance. <br /> <br />The Mayor then introduced for consideration appointments to the Urban <br />Renewal Board. Mr. Richard Cruz and Everado Duran were nominated for <br />reappointment. Mr. James moved to confirm the reappointment of both <br />members. Mr. Tenorio seconded the motion which passed unanimously. <br />
