I:i:i ~ <br />c::) C:::c; <br />..-..I f:d~ <br />CI:) _ <br />co >0 <br />t::= '=b <br />C,;)u <br /> <br />53 <br /> <br />ORDINANCE 1999- 17 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 1.38 ACRE TRACT OF <br />PROPERTY LOCATED AT 1328 I.H. 35 NORTH FROM "C" <br />COMMERCIAL DISTRICT TO "MF-4" MULTI-FAMILY <br />RESIDENTIAL DISTRICT ; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On January 12, 1999, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "C" <br />Commercial District to "MF-4" Multi-Family Residential District (High Density) for a 1.38 <br />acre tract of property located at 1328 I.H. 35 North. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on 1-12-99 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the <br />March , 1999, regarding the request. <br /> <br />??nn day of <br /> <br />4. All requirements of Chapter 114, Zoning, ofthe San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "C" Commercial District to "MF-4" Multi-Family Residential District (High <br />Density): <br /> <br />Street address: <br /> <br />1328 I. H. 35 North <br /> <br />Size: 1.38 acres. <br /> <br />Legal description: A portion of Lot 3 of the Luis Gil Addition, a metes and bounds <br />description of which is attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 3, page 383, Hays County Plat Records. <br /> <br />SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City.
