<br />~ <br />r- ~ <br />D~ '!':" <br />g ..... <br />u ~ <br />U... ~'~'l. 0.... <br />c:; <br />Wet :a: <br /> <br />~..I <br />!."3Ji. <br />tj:!ill <br />e;::.- <br />!;.:fS <br />~~ <br /> <br />146 <br /> <br />ORDINANCE 1999-~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIALZONING <br />MAP OF THE CITY BY REZONING A 0.73 ACRE TRACT OF <br />PROPERTY LOCATED AT 501 AND 503 RIVER ROAD <br />FROM "M" SINGLE-FAMILY, DUPLEX AND <br />NEIGHBORHOOD BUSINESS DISTRICT TO "MF-3 MUL TI- <br />FAMILY DISTRICT (HIGH DENSITY); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENAL TIES. <br /> <br />RECITALS: <br /> <br />1. On March 9, 1999, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "M" Single- <br />Family, Duplex and Neighborhood Business District to "MF-3 Multi-Family District (High <br />Density) for a 0.73 acre tract of property located at 501 and 503 River Road. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on March 9, 1999 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 26th day of <br />April , 1999, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health,' morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "M" Single-Family, Duplex, and Neighborhood Business District to "MF-3" <br />Multi-Family District (High Density): <br /> <br />Street address: <br /> <br />501 and 503 River Road. <br /> <br />Size: 0.73 acres. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 373, Page 669, Hays County Deed Records. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. All ordinances or parts of ordinances in conflict with this ordinance are <br />repealed. The publication of notice on April 4, 1999 of the public hearing by the City <br />Council is validated, and for this purpose, this ordinance supersedes Section 114.023 of <br />the City Code. <br /> <br />SECTION 5. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City.
