ORDINANCE NO. 2012 -23 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE SAN MARCOS CITY CODE TO ESTABLISH A PARKING RESTRICTION TO PROHIBIT PARKING, MONDAY THROUGH FRIDAY BETWEEN THE HOURS OF 8:00 A.M. AND 5:00 P.M. ON BOTH SIDES OF THE 1200 THROUGH 1300 BLOCKS OF CHESTNUT STREET; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. Section 82.160 authorizes the designation by sign of restricted parking areas which are reflected in the City's Traffic Register under Section 82.067 of the City Code. A need has been established to provide restricted parking areas along the 1200 through 1300 blocks of Chestnut Street between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: . SECTION 1. The Traffic Register under Section 82.067 of the San Marcos City Code is amended to establish the following restriction on parking on both sides of the 1200 through 1300 Blocks of Chestnut Street: "NO PARKING, MONDAY - FRIDAY, 8:00 A.M. TO 5:00 P.M." SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. This ordinance shall be in effect upon adoption on second reading and publication if publication is required by law. PASSED AND APPROVED on first reading on April 17, 2012.
