<br /> <br />(,)0 <br />0- <br />g: <br /> <br /> <br />~.......,,~ <br /> <br />(\j <br />;z: <br />~ <br />~ <br /> <br />ORDINANCE 1998 - 10 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 82.269 OF THE CITY CODE <br />REGARDING BICYCLING AND SKATING ON DOWNTOWN SIDEWALKS <br />BY CHANGING "CENTRAL BUSINESS DISTRICT" TO "CBA CENTRAL <br />BUSINESS AREA"; INCLUDING PROCEDURAL PROVISIONS AND <br />PROVIDING FOR PENALTIES. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. <br />as follows: <br /> <br />Section 82.269 of the San Marcos City Code is amended <br /> <br />Sec. 82.269. Riding on sidewalks. <br /> <br />(a) It is unlawful for a person to ride a bicycle, adult-sized tricycle, roller <br />skates, in-line skates, skateboard or any similar device or vehicle on any sidewalk <br />within the CBA Central business area zoninQ district. Peace officers and park <br />ranQers are exempt from these rules to the extent these rules conflict with the <br />discharQe of their official duties. <br /> <br />(b) Whenever any person is riding a bicycle upon a sidewalk, that person <br />shall yield the right-of-way to any pedestrian and shall give an audible signal before <br />overtaking and passing the pedestrian. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent <br />jurisdiction, the other provisions of this ordinance will continue in force if they can <br />be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolutions or parts of ordinances or <br />resolutions in conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits <br />a misdemeanor and is subject to the penalty provided in Section 1.015 of the San <br />Marcos City Code upon conviction. <br /> <br />SECTION 5. This Ordinance takes effect ten (10) days after the date of <br />its final passage, and the City Secretary will publish notice of its adoption in a <br />newspaper of general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading January 26, 1998. <br /> <br />PASSED AND APPROVED on second reading February 9, 1998. <br /> <br />PASSED, APPROVED AND ADOelED ~ebrUary 23, <br />Bil~'t~ <br /> <br />Mayor <br /> <br />1998. <br /> <br /> <br />Approved: <br />~ <br />Mark B.
