ORDINANCE 2003- 17 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING A 20.26 ACRE TRACT OF PROPERTY LOCATED IN THE 3900 TO 4700 BLOCKS OF STATE HIGHWAY 123 AS "DPR-2" TWO- FAMILY RESTRICTED DWELLING DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. 153. o RECITALS: 1. On January 14, 2003, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to establish the zoning as "DPR-2" Two-Family Restricted Dwelling District (Medium Density) for a 20.26 acre tract of property located in the 3900 to 4700 Blocks of State Highway 123. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on January 14, 2003, consider and vote to approve the request, and has recommended that the request be approved by the City CotmciI of the City. 3. The City Council held a public hearing on the 2 4th 2003, regarding the request. __ day of iqarch _, 4. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION I. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to establish the zoning for the following real property as "DPR-2" Two-Family Restricted Dwelling District (Medium Density): Street address: 3900 to 4700 Blocks of State Highway 123.
