ORDINANCE 2003- 17 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY ZONING A 20.26 ACRE <br />TRACT OF PROPERTY LOCATED IN THE 3900 TO 4700 <br />BLOCKS OF STATE HIGHWAY 123 AS "DPR-2" TWO- <br />FAMILY RESTRICTED DWELLING DISTRICT (MEDIUM <br />DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br /> 153. <br /> <br />o <br /> <br />RECITALS: <br /> <br /> 1. On January 14, 2003, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to establish the zoning as "DPR-2" Two-Family <br />Restricted Dwelling District (Medium Density) for a 20.26 acre tract of property located in the <br />3900 to 4700 Blocks of State Highway 123. <br /> <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on January 14, 2003, consider and vote to approve the request, and has recommended that <br />the request be approved by the City CotmciI of the City. <br /> <br /> 3. The City Council held a public hearing on the 2 4th <br />2003, regarding the request. <br /> <br />__ day of iqarch _, <br /> <br /> 4. Ali requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to <br />zoning map amendments have been met. <br /> <br /> 5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION I. The Official Zoning Map of the City, as described in Section 114.029 of <br />the San Marcos City Code, is amended to establish the zoning for the following real property as <br />"DPR-2" Two-Family Restricted Dwelling District (Medium Density): <br /> <br />Street address: 3900 to 4700 Blocks of State Highway 123. <br /> <br />Size: 20.26 acres. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 1326, page 279, Hays County Deed Records. <br /> <br /> <br />
