<br />I <br /> <br />I <br /> <br />I <br /> <br />RESOLUTION 2007- 4 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING AN EMERGENCY CONSTRUCTION CONTRACT <br />WITH DU-MOR ENTERPRISES, INe. FOR THE <br />FIELD/CHEA THAM/HA YNES W ASTEW A TER MAIN EMERGENCY <br />INSTALLATION PROJECT; RATIFYING THE CITY MANAGER'S <br />EXECUTION OF THE CONTRACT DOCUMENTS ON BEHALF OF THE <br />CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. In October of 2006 the City Engineering Department received notice that a section <br />of wastewater main in the Rio Vista neighborhood collapsed to an irreparable condition which <br />left a block of 18 residences without properly functioning wastewater collection facilities. <br /> <br />2. In order to restore safe and appropriate service to the area's residences as well as <br />to reduce surcharge conditions, the City engaged Du-Mor Enterprises, Inc. for the necessary work <br />due to its immediate availability and extensive experience in the work required for this Project. <br /> <br />3. The City Council finds and determines that it was necessary to enter into this <br />construction contract on an emergency basis without formal competitive bidding in order to <br />preserve and protect the public health and safety of the City's residents. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The award of an emergency contract to Du-Mor Enterprises, Inc. for the <br />FieldlCheathamlHaynes Wastewater Main Emergency Installation Project in the amount of <br />$92,802.50 is approved. <br /> <br />PART 2.
