<br />ORDINANCE NO. 2007- 3 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING AN AMENDMENT TO <br />THE FUTURE LAND USE MAP FROM INDUSTRIAL TO <br />COMMERCIAL FOR A 1.7 ACRE, MORE OR LESS, TRACT <br />OF PROPERTY LOCATED AT 1560 IH-35 SOUTH; <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM "HI" HEAVY INDUSTRIAL <br />DISTRICT TO "GC" GENERAL COMMERCIAL DISTRICT; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />RECIT ALS: <br /> <br />1. On November 14, 2006" the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the Future Land Use Map of the San <br />Marcos Horizons City Master Plan from Industrial to Commercial, and a concurrent request to <br />change the zoning from HI Heavy Industrial District to GC General Commercial District, for a <br />1.7 acre, more or less, tract of land located at 1560 IH-35 South. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on November 14, 2006, and recommended that the <br />requests be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on January 8, 2007 <br />requests. <br /> <br />regarding the <br /> <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1.
