ORDINANCE NO. 2007- 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM INDUSTRIAL TO COMMERCIAL FOR A 1.7 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED AT 1560 IH-35 SOUTH; AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS TRACT FROM "HI" HEAVY INDUSTRIAL DISTRICT TO "GC" GENERAL COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECIT ALS: 1. On November 14, 2006" the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the Future Land Use Map of the San Marcos Horizons City Master Plan from Industrial to Commercial, and a concurrent request to change the zoning from HI Heavy Industrial District to GC General Commercial District, for a 1.7 acre, more or less, tract of land located at 1560 IH-35 South. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission considered and voted to approve the requests on November 14, 2006, and recommended that the requests be approved by the City Council of the City. 3. The City Council held a public hearing on January 8, 2007 requests. regarding the 4. All requirements of Chapter 1, Development Procedures, of the City Land Development Code pertaining to Future Land Use Map Amendments and Zoning Map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1.
