I I I ORDINANCE NO. 2007- 21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY'S 2006-2007 CAPITAL IMPROVEMENT PLAN BUDGET TO ADD THE CONFERENCE CENTER AS A LINE ITEM, TO FUND THE CONFERENCE CENTER BUDGET WITH THE PROCEEDS FROM THE JANUARY 2007 SALE OF GENERAL OBLIGA nON BONDS; AND DECLARING AN EMERGENCY. RECITALS: In accordance with Section 8.16 of the City Charter, the City Council declares that a public necessity exists that requires an amendment to the City's 2006-2007 Budget. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION l. The City Budget Ordinance for the 2006-2007 Fiscal Year is amended by adding a budget line to the CIP for the City of San Marcos Conference and funding that line item with the proceeds received from the sale of the January 2007 general obligation bonds. SECTION 2. These revisions and reappropriations will be incorporated into the 2006- 2007 City Budget. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. The importance of this Ordinance creates an emergency and an imperative public necessity, and the provisions of the Charter requiring that ordinances be presented at three separate meetings, and that ordinances do not take effect until ten days after the date of its final passage are suspended, and this Ordinance will take effect upon publication of notice of its adoption in a newspaper of general circulation within the City.
