<br />Ç>O <br />CJ' 118 <br />cr- <br />- <br />- <br />C\1 <br />Q;: <br />=' ORDINANCE 1998----1.8 <br />~ <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br /> MAP OF THE CITY BY REZONING LOT 1, B.Go COLLIER <br /> ADDITION, LOCATED AT 1605 POST ROAD FROM "M" <br /> SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD <br /> BUSINESS DISTRICT TO "R-1" SINGLE-FAMILY DWELLING <br /> DISTRICT (LOW DENSITY); INCLUDING PROCEDURAL <br /> PROVISIONS; AND PROVIDING FOR PENAL TIES. <br /> RECITALS: <br /> 1. On March 1 0, 1998, the Planning and Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the zoning from "M" Single- <br /> Family, Duplex and Neighborhood Business District to "R-1" Single-Family Dwelling <br /> District (Low Density) for Lot 1, B.G. Collier Addition located at 1605 Post Roado <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br /> Commission did, on March 10, 1998 consider and vote to approve the request, and has <br /> recommended that the request be approved by the City Council of the City. <br /> 3. The City Council held a public hearing on the 13th day of <br /> April , 1998, regarding the request. <br /> <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br /> to zoning map amendments have been met. <br /> 5. The City Council hereby finds and determines that the adoption of the following <br /> ordinance is in the interest of the public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 10 The Official Zoning Map of the City, as described in Section 114.029 <br /> of the San Marcos City Code, is amended to rezone the following real property which is <br /> presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "R-1" <br /> Single-Family Dwelling District (Low Density): <br /> Street address: 1605 Post Road <br /> Legal description: Lot 1 of the B.G. Collier Addition. <br /> <br /> Deed or plat reference: Volume 108, page 34, Hays County Deed Records. <br /> <br /> SECTION 2. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 10015 of the San Marcos <br /> City Code upon conviction. <br /> SECTION 3. After its original passage, this ordinance will be subject to <br /> reconsideration at the next regular City Council meetingo If this ordinance is not <br /> reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br /> in a newspaper of general circulation in the City.
