ORDiNANCE 2003- 23 AN ORDiNANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS, CANVASSiNG RETURNS AND DECLARING RESULTS OF THE GENERAL ELECTION, HELD ON MAY 3, 2003 FOR THE PURPOSE OF ELECTiNG A CITY COUNCIL MEMBER, PLACE 5, AND A CITY COUNCIL MEMBER, PLACE 6; AND DECLARING AN EMERGENCY. RECITALS: 1. The City Council ordered that a General Election be held on May 3, 2003 purpose of electing a Council Member, Place 5, and a Council Member, Place 6. 38. O ~ 6,2003. Notice of this election was duly published in the San Marcos Daily Record on April 2003. A copy of the notice was posted on the bulletin board at City Hall on Februm'y 28, 4. This election was duly and legally held on May 3, 2003, in conformity with the election laws of the State of Texas, and the results of the election have been certified and returned by the proper judges and clerks. 5. The City Council of the City of San Marcos, Texas with the following members present: Ed Mihalkanin, Jacob Montoya, Susan Narvaiz, Mayor Habingreither, Bill Taylor, Paul Mayhew and Martha ~ax~u~oday considered the returns of the General election held on May 3, 2003. 6. It appears to the Council, and the Council finds, that the election was in all respects lawfully held. 7. It appears to the Council, and Council finds, that the tabulation of the result of the election is correct. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The General Election of May 3,2003 was duly called, notice of the election was given in accordance with law, and the election was held in accordance with the law. SECTION 2. The tabulation of votes cast in the General election held on May 3, 2003 for the purposes stated in recital 1 above, a copy of which is attached to and made a part of this
