<br /> 65 <br /> RESOLUTION 1997- - l4 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, RESCINDING THE CONTRACT AWARD MADE TO <br />BOISE CASCADE OFFICE PRODUCTS FOR THE PROVISION OF OFFICE <br />SUPPLIES; AWARDING A CONTRACT TO ADVANCED BUSINESS <br />SYSTEMS, INC. FOR THE PROVISION OF OFFICE SUPPLIES; AND <br />DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br />1. The City received identical bids for a contract for the provision of office <br /> supplies (the "Contract") from Boise Cascade Office Products and Advanced Business <br /> Systems, Inc. <br />2. The City drew lots and awarded the Contract to Boise Cascade. <br />3. Subsequent to the award of the Contract it was determined that state law <br /> mandates that in the case of receipt of identical bids where one bidder is a resident of the <br /> municipality, then award must be made to the resident bidder. <br />2. The City Council has reconsidered its award of the contract and determined <br /> that it in accordance with State law the contract must be awarded to Advanced Business <br /> Systems and not Boise Cascade. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br />PART 1. The contract award made to Boise Cascade Office Products for the <br /> purchase of office supplies for IFB 97-018 in an estimated annual amount of $42,000.00 <br /> is rescinded. <br />PART 2. Award of a contract for the purchase office supplies for IFB-97-018 to <br /> Advanced Business Systems, Inc. in the estimated annual amount of $42,000.00 is <br /> approved. <br />PART 3. The Purchasing Manager, Cheryl Pantermuehl, is authorized to <br /> execute appropriate contract documents on behalf of the City. <br />PART 4. That this Resolution shall be in full force and effect immediately from and <br /> after its passage. <br /> ADOPTED this the 27th day of January 1997. <br /> l~~~ ~ <br /> Billy G.
