' <br /> <br />Recitals: <br /> <br />1. V.T.C.A., Local Government Code Section 51.016 provides for the adoption <br />by a municipality of a corporate seal for the use of the municipality. <br /> <br />2. An official insignia for the City of San Marcos was approved and adopted by <br />resolution of the San Marcos City Council, effective July 10, 1989. <br /> <br />3. The San Marcos City Council desires to limit the use of the official city <br />insignia in order to preserve its meaning and dignity and to prevent <br />unauthorized use of the insignia that implies city support or approval. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Chapter 1 of the San Marcos City Code is amended by adding <br />Section 1.017 to read as follows: <br /> <br />Sec. 1.017. Adoption of city insignia; restrictions on use. <br /> <br />(a) The seal and insignia of the City of San Marcos, approved by the city council <br />in Resolution 1989 - 64R, is adopted as the official seal and insignia of the city. <br /> <br />(b) The city seal and insignia will be used only for official city purposes. It is <br />unlawful for a person other than city officers, employees and agents to use the official seal <br />or insignia without the written permission of the city manager. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br />other provisions of this ordinance will continue in force if they can be given effE?ct without <br />the invalid portion. <br /> <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 5. This Ordinance takes effect ten (10) days after the date of its final <br />passage, and the City Secretary will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading January 21, 1997. <br /> <br />PASSED AND APPROVED on second reading January 27, 1997 <br />
