¡ . 1 I I ; I I i. 16 RESOLUTION 1997 - 19R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING AN AMENDMENT TO THE LICENSE AGREEMENT BETWEEN THE CITY AND M-Y CONSTRUCTION CO., LLC. FOR THE USE OF A PORTION OF FURMAN STREET FOR THE PURPOSE OF PROVIDING DRIVEWAY ACCESS; AUTHORIZING THE CITY MANAGER TO EXECUTE THE LICENSE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. M- Y Construction Co. L.L.C. ("M-Y') owns property located at the comer of Franklin Drive and Furman Street. . 2. On March 26, 1996 the City entered into a License Agreement with M-Y to use a portion of the undeveloped right-of-way of Furman Street, between Franklin Drive and Clyde Street, for the purpose of providing driveway access to M-Y's property. 3. The attached Amendment would limit the City's ability to terminate the License Agreement to situations where the Licensee has violated the License Agreement, or where the City is opening or abandoning the adjacent portion of Furman Street, it also provides that M-Y may terminate the License by giving the City 60 days written notice. IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The attached Amendment to the License Agreement between the City and M-Y Construction Co. LL.C. is approved. PART 2. The City Manager, Larry D. Gilley, is authorized to e~ecute the Amendment to the License Agreement. PART 3. its passage.
