On March 11 1997, the Planning and Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the zoning from "M" Single- <br /> Family Duplex. and Neighborhood Business District to "R-2" Single-Family Dwelling <br /> District (Medium Density) for Lot 11, Southend Addition located at 408 Railroad Street. <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br /> Commission did, on March 11, 1997 consider and vote to approve the request, and has <br /> recommended that the request be approved by the City Council of the City. <br /> .. <br /> 3. The City Council held a public hearing on the ?Rn.¡ day of <br /> APRTI , 1997, regarding the request. <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br /> to zoning map amendments have been met. <br /> 5. The City Council hereby finds and determines that the adoption of the following <br />-, ordinance is in the interest of the public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br /> of the San Marcos City Code, is amended to rezone the following real property which is <br /> presently zoned "M" Single-Family Duplex and Neighborhood Business District to "R-2" <br /> Single-Family Dwelling District (Medium Density): <br /> Street address: 408 Railroad Street <br /> Legal description: Lot 11 of the Southend Addition. <br /> Deed or plat reference: Volume 55, pages 600-601, Hays County Deed Records. <br /> SECTION 2. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br /> SECTION 3. After its original passage, this ordinance will be subject to <br /> reconsideration at the next regular City Council meeting. If this ordinance is not <br /> reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br /> in a newspaper of general circulation in the City.
