<br /> - 145 <br />Q~ ~ ~ ~ <br />a: L.t.J::E <br />I.l!ë:> ~ =:= ORDINANCE 1997- 15 <br />. - u "" <br />..J~ G' ~~ - <br />-~ = 0 <br />u.;.1 :¡ :à ¡::: ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />. ~c.::» <br /> SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br /> MAP OF THE CITY BY REZONING A 4.14 ACRE TRACT OF <br /> PROPERTY LOCATED AT THE INTERSECTION OF <br /> STAGECOACH ROAD AND HUNTER ROAD FROM "TH-2" <br /> TOWNHOUSE RESIDENTIAL DISTRICT (MEDIUM DENSITY) <br /> AND "C" COMMERCIAL DISTRICT TO "C" COMMERCIAL <br /> DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br /> PROVIDING FOR PENALTIES. <br />RECITALS: <br /> 1. On March 27, 1997, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "TH-2" <br />Townhouse Residential District (Medium Density) and IIC" Commercial District to "C" <br />Commercial District for a 4.14 acre tract of property located at the intersection of <br />Stagecoach Road and Hunter Road. <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on March 27, 1997 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> 3. The City Council held a public hearing on the 28TH day of <br /> APRIL , 1997, regarding the request. <br /> <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> 5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "TH-2" Townhouse Residential District (Medium Density) and "C" <br />Commercial District to "C" Commercial District: <br /> Street address: Intersection of Stagecoach Road and Hunter Road <br /> <br /> Size: 4.14 acres. <br /> Legal description: See~attached Exhibit A. <br /> <br /> Deed or plat reference: Volume 908, page 309, Hays County Official Public <br /> Records. <br /> SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br />
