'::J - :..u c.") <br /><J en <br />---i z õ <br />WVJ --:: ¡:::~ ORDINANCE 1996- 2 <br />,~ ~'r-f <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 0.41 ACRE TRACT OF <br />PROPERTY LOCATED AT THE CORNER OF ALLEN AND <br />DELMAR STREETS FROM "TH-1" TOWNHOUSE. <br />RESIDENTIAL DISTRICT (LOW DENSITY) TO "R-1" SINGLE- <br />FAMILY DWELLING DISTRICT (LOW DENSITY); INCLUDING <br />PROCEDURAL PROVISIONS AND PROVIDING FOR <br />PENAL TIES. <br /> <br />RECITALS: <br /> <br />1. On October 24, 1995, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "TH-1" <br />Townhouse Residential District (Low Density) to "R-1" Single-Family Dwelling District (Low <br />Density for a 0.41 acre tract of property located at the corner of Allen and Delmar Streets. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on October 24, 1995 consider and vote to approve the request, and has <br />. <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 22nd day of <br />January , 1996, regarding the request. <br /> <br />4. All requirements of Appendix A, General Zoning Ordinance, of the Code of <br />Ordinances of the City of San Marcos pertaining to amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official Zoning Map of the City, as described in Section 3 of <br />the General Zoning Ordinance is amended to rezone the following real property which is <br />presently zoned "TH-1" Townhouse Residential District (Low Density) to "R-1" Single- <br />Family Dwelling District (Low Density): <br /> <br />Street address: Corner of Allen and Delmar Streets <br /> <br />Size: 0.41 acres. <br /> <br />Legal description: Lots 388 and 389 of the Westover Addition. <br /> <br />Deed or plat reference: Volume 146, page 184-185, Hays County Deed Records. <br /> <br />SECTION 2. That any person violating any provision of this ordinance shall be <br />deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br />provided in Section 1-5 of the San Marcos Code of Ordinances. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 22 day of January, 1996, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />February 12, 1996. <br />
