'::J - :..u c.") <J en ---i z õ WVJ --:: ¡:::~ ORDINANCE 1996- 2 ,~ ~'r-f AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.41 ACRE TRACT OF PROPERTY LOCATED AT THE CORNER OF ALLEN AND DELMAR STREETS FROM "TH-1" TOWNHOUSE. RESIDENTIAL DISTRICT (LOW DENSITY) TO "R-1" SINGLE- FAMILY DWELLING DISTRICT (LOW DENSITY); INCLUDING PROCEDURAL PROVISIONS AND PROVIDING FOR PENAL TIES. RECITALS: 1. On October 24, 1995, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "TH-1" Townhouse Residential District (Low Density) to "R-1" Single-Family Dwelling District (Low Density for a 0.41 acre tract of property located at the corner of Allen and Delmar Streets. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on October 24, 1995 consider and vote to approve the request, and has . recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 22nd day of January , 1996, regarding the request. 4. All requirements of Appendix A, General Zoning Ordinance, of the Code of Ordinances of the City of San Marcos pertaining to amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the Official Zoning Map of the City, as described in Section 3 of the General Zoning Ordinance is amended to rezone the following real property which is presently zoned "TH-1" Townhouse Residential District (Low Density) to "R-1" Single- Family Dwelling District (Low Density): Street address: Corner of Allen and Delmar Streets Size: 0.41 acres. Legal description: Lots 388 and 389 of the Westover Addition. Deed or plat reference: Volume 146, page 184-185, Hays County Deed Records. SECTION 2. That any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in Section 1-5 of the San Marcos Code of Ordinances. SECTION 3. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice. PASSED, APPROVED AND ADOPTED this 22 day of January, 1996, subject to reconsideration at the next regular City Council meeting scheduled for February 12, 1996.
