<br />-.3 <br />~ ~ ;:::: ~ 50 <br />Q~ q: ~~ <br />1.1 g -:..ù:i!. <br />~<3 9==-= <br />;.j -0 ~ Ecl ðลก <br />-~¡ ~Õ <br />~:1 - ~~ ORDINANCE 1996-~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 0.56 ACRE TRACT OF <br />PROPERTY LOCATED AT 418 LINDA DRIVE FROM "C" <br />COMMERCIAL DISTRICT TO "MF-3" MULTI-FAMILY, <br />DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On December 12, 1995, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "C" <br />Commercial Dis\riçt to "MF-3" Multi-Family District (High Density) for a 0.56 acre tract of <br />property located at 418 Linda Drive. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on December 12, 1995 consider and vote to approve the request, and <br />has recommended that the request be approved by the City Council of the City. <br /> <br />~ <br />3. The City Council held a public hearing on the 1 ?t-h day of <br />February , 1996, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos Code pertaining to <br />zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />; <br />, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official Zoning Map of the City, as described in Section <br />114.029 of the San Marcos City Code is amended to rezone the following real property <br />which is presently zoned "C" Commercial District to "MF-3" Multi-Family District (High <br />Density): <br /> <br />Street address: 418 Linda Drive. <br /> <br />Size: 0.56 acres. <br /> <br />Legal description: A portion of Lot 8, Rogers Subdivision, a metes and bounds <br />description of which is attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 976, page 152, Hays County Deed Records. <br /> <br />SECTION 2. That any person violating any provision of this ordinance shall be <br />deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br />provided in Section 1.015 of the San Marcos City Code. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 12 day of February, 1996, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />February 26, ~996. <br />
