Q AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING THE ABANDONMENT OF THE PORTION <br /> OF PECAN STREET LOCATED BETWEEN SESSOM DRIVE AND LIVE <br /> OAK STREET; APPROVING THE SALE OF THIS RIGHT-OF-WAY TO <br /> SOUTHWEST TEXAS STATE UNIVERSITY; AUTHORIZING THE CITY <br /> MANAGER TO EXECUTE A DEED; AND DECLARING AN EMERGENCY. <br /> . ~ <br /> RECITALS: <br /> 1. On December 12, 1995, the City Planning and Zoning Commission conducted <br /> a public hearing on the proposed abandonment of a 0.357 acre tract of right-of-way if <br /> Pecan Street between Sessom Drive and Live Oak Street, and voted unanimously to <br /> approve the proposal. <br /> 0' , <br /> 2. The City has compiled with the requirements of Section 272.001 of the Texas <br /> Local Government Code regarding the sale of property by a municipality. <br /> 3. The City has received appraisals indicating the value of this segment of right- <br /> of-way is $23,400. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> SECTION 1. That the abandonment of 0.357 acre tract right-of-way of Pecan Street <br /> described by metes and bounds on the Exhibit" An of the deed attached to this ordinance <br /> is approved. <br /> SECTION 2. That the sale of the parcel of the right-of-way described above for <br /> $23,400 to Southwest Texas State University is approved. <br /> SECTION 3. That the City Manager, Larry D. Gilley, is authorized to execute the <br /> Special Warranty Deed attached to this ordinanèe conveying to Southwest Texas State <br /> University the right-of-way described above, subject to the reservation of a public utility <br /> easement covering the entire property. <br /> SECTION 4. That the importance of this Ordinance creates an emergency and an <br /> imperative public necessity to that the provisions of the Charter requiring that ordinances <br /> shall be presented at three separate meetings and that no ordinance shall bec°rT!e effective <br /> until the expiration of ten (10) days following the date of its final passage be suspended, <br /> and these provisions are hereby suspended, and this Ordinance shall take effect and be <br /> in full force and effect from and after its adoption and after its publication in a newspaper <br /> of general circulation within the City as provided by the City Charter of the City of San <br /> Marcos. <br /> PASSED, APPROVED AND ADOPTED this 12th day of February ,1996. <br /> l~r~' ~ <br /> Mayor <br /> cl. ~øf~ Approved: <br /> Mark B.
