<br />COUNCIL MEMBER, PLACE FOUR; AND TO BE HELD WITHIN
<br />THE BOUNDARIES OF THE SCHOOL DISTRICT FOR THE
<br />PURPOSE OF ELECTING A SCHOOL DISTRICT BOARD OF
<br />TRUSTEES MEMBER, PLACE 1, AND A SCHOOL DISTRICT
<br />BOARD OF TRUSTEES MEMBER, PLACE 2, AND A SCHOOL
<br />DI~rRICT BOARD OF TRUSTEES MEMBER, PLACE 3, AND TO
<br />SUBMIT BALLOT PROPOSITIONS TO THE VOTERS FOR
<br />PROPOSED AMENDMENTS TO THE CITY CHARTER AND A
<br />PROPOSED LEASE OF PARKLAND TO THE SAN MARCOS
<br />YOUTH SOCCER ASSOCIATION; ESTABLISHING EARLY VOTING
<br />LOCATIONS AND POLLING PLACES FOR THIS ELECTION;
<br />MAKING PROVISIONS FOR THE CONDUCT OF THE ELECTION;
<br />.
<br />AND DECLARING AN EMERGENCY.
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That a joint general and special election is ordered to be held by the
<br />City of San Marcos (City) and the San Marcos Consolidated Independent School District
<br />(School District), at the various polling places and election precincts within the corporate
<br />I limits of the City, and within the boundaries of the School District, as hereinafter
<br />designated, on the 4th day of May, 1996, from the hours of 7:00 a.m. to 7:00 p.m., at
<br />which election there shall be elected by the qualified voters of the City, a Mayor for a term
<br />of two years, and a City Council Member for Place Three and a City Council Member for
<br />Place Four, for terms of three years each, and by the qualified voters of the School
<br />District, a School District Board of Trustees Member, Place 1, a School District Board of
<br />Trustees Member, Place 2, and a School District Board of Trustees Member, Place 3, for
<br />terms of three years each, and at which election there shall be submitted to tl:1e qualified
<br />voters of the City, ballot propositions for proposed amendments to the City Charter and a
<br />proposed lease of parkland to the San Marcos Youth Soccer Association, in accordance
<br />with applicable provisions of the City Charter and State law.

<br />SECTION 2. That the following measures will be submitted to the qualified voters
<br />of the City at the election, in accordance with Section 9.004 of the Texas Local
<br />Government Code and Sections 3.07(a), 12.11 and 12.12 of the San Marcos City Charter
<br />and other applicable laws:

<br />
<br />SHALL SECTION 3.02(A)(4) OF THE CITY CHARTER BE AMENDED TO
<br />READ AS FOLLOWS:

<br />- (4) Shall not be an officer or director of any public utility within the city, or outside
<br />the city but serving inhabitants of the city, nor be the owner or proprietor of
<br />any public utility in the city. A public utility is any company, individual,
<br />partnership, corporation or other entity recognized by law that uses any of
<br />the city's streets, alleys, highways or grounds to carry out its primary
<br />purpose, including but not limited to sewer, gas, electricity,
<br />telecommunications, commercial railway or street railway services.
