That Division 4, Article 3, Chapter 2 of the San Marcos City Code is <br /> amended to read as follows: <br /> DIVISION 4. SENIOR CITIZEN FACILITIES ADVISORY BOARD <br /> Sec, 2.131. Established; appointment; terms. <br /> (a) There is established the senior citizen facilities advisory board. The <br /> board is composed of seven residents of the city interested in the welfare of <br /> senior citizens. <br /> ~ <br /> (b) The director of parks and recreation and the executive director of the <br /> community action program are ex officio nonvoting members of the board. <br /> (c) Members of the board are appointed by the city council for terms of <br /> two years and until their successors are appointed and qualified. <br /> Sec. 2,132, Powers and duties. <br /> (a) The senior citizen facilities advisory board may adopt rules and <br /> regulations to govern its actions, subjeèt to the general laws of the state and city <br /> ordinances and resolutions. <br /> (b) The board acts in an advisory capacity to the city council and city <br /> manager in the provision of facilities for leisure time pursuits of senior citizens. <br /> The board will advise the city manager and the city council concerning existing <br /> facilities and future plans for facilities involving senior citizens. <br /> (c) The board will promote close cooperation between the city and private <br /> citizens, institutions and agencies interested in senior citizen facilities to the end <br /> that resources within the city are coordinated to secure the greatest degree of <br /> public benefit. <br /> SECTION 2. That if any word, phrase, clause, sentence, or paragraph of this <br /> ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br /> remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br /> invalid portion had not been adopted. <br /> SECTION 3. That all ordinances and resolutions or parts of ordinances or <br /> resolutions in conflict herewith are hereby repealed. <br /> SECTION 4. That any person violating any provision of this ordinance shall be <br /> deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br /> provided in Section 1-5 of the San Marcos Code of Ordinances. <br /> SECTION 5. That this Ordinance shall take effect ten (10) days from and after its <br /> passage, and it shall be published in a newspaper of general circulation in the area as <br /> required by the Charter of the City of San Marcos, Texas. <br /> PASSED AND APPROVED on first reading January 8, 1996. <br />
