:-¡g 58 e::: 0 ¡::::;; ~. - 4J~ r-.- \\..: G~ ¡.u= ::= CI?'jS = ~b ORDINANCE 1900-~ ;;:: Q~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ADOPTING A NEW CITY CODE FOR THE CITY OF SAN MARCOS, TEXAS, INCLUDING A REORGANIZATION OF THE CITY'S ZONING ORDINANCES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Code entitled "San Marcos City Code" published in 1995 by Municipal Code Corporation, consisting of Chapters 1 through 114, each inclusive, and including a reorganization of the City's zoning ordinances, is adopted. SECTION 2. All ordinances of a general and permanent nature enacted on or before April 1 0, 1995, and not included in the Code or recognized and continued in force by reference therein are repealed; and all ordinances amending the previous San Marcos Code of Ordinances, adopted by the City Council since April 1 0, 1995, will be codified as revisions to the Code by the publisher. SECTION 3. The repeal provided for in Section 2 shall not be construed to revive ~ any ordinance or part thereof that has been repealed by a subsequent ordinance that is repealed by this ordinance. SECTION 4. Unless another penalty is expressly provided, every person who violates any provision of the Code is subject to the penalties provided in Section 1.015 of the Code, as well as to other remedies available to the City. SECTION 5. Additions or amendments to the Code when passed in the form as to indicate the intention of the city to make the same a part of the Code shall be deemed to be incorporated in the Code, so that reference to the Code includes the additions and amendments. SECTION 6. That if any word, phrase, clause, sentence, or paragraph of the Code or this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of the Code and this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 7. That all ordinances and resolutions or parts of ordinances or resolutions in conflict herewith are repealed. SECTION 8. That any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in Section 1-5 of the San Marcos Code of Ordinances. SECTION 9- That this Ordinance shall be in effect ten days from and after its passage, and notice of its adoption shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
