<br /> :-¡g 58 <br /> e::: 0 <br /> ¡::::;; <br /> ~. - 4J~ <br /> r-.- <br /> \\..: G~ <br /> ¡.u= <br /> ::= CI?'jS <br /> = ~b ORDINANCE 1900-~ <br /> ;;:: <br /> Q~ <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, ADOPTING A NEW CITY CODE FOR THE CITY <br /> OF SAN MARCOS, TEXAS, INCLUDING A REORGANIZATION OF <br /> THE CITY'S ZONING ORDINANCES; INCLUDING PROCEDURAL <br /> PROVISIONS; AND PROVIDING FOR PENAL TIES. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> SECTION 1. The Code entitled "San Marcos City Code" published in 1995 by <br /> Municipal Code Corporation, consisting of Chapters 1 through 114, each inclusive, and <br /> including a reorganization of the City's zoning ordinances, is adopted. <br /> SECTION 2. All ordinances of a general and permanent nature enacted on or <br /> before April 1 0, 1995, and not included in the Code or recognized and continued in force <br /> by reference therein are repealed; and all ordinances amending the previous San Marcos <br /> Code of Ordinances, adopted by the City Council since April 1 0, 1995, will be codified as <br /> revisions to the Code by the publisher. <br /> SECTION 3. The repeal provided for in Section 2 shall not be construed to revive <br /> ~ <br /> any ordinance or part thereof that has been repealed by a subsequent ordinance that is <br /> repealed by this ordinance. <br /> SECTION 4. Unless another penalty is expressly provided, every person who <br /> violates any provision of the Code is subject to the penalties provided in Section 1.015 of <br /> the Code, as well as to other remedies available to the City. <br /> SECTION 5. Additions or amendments to the Code when passed in the form as to <br /> indicate the intention of the city to make the same a part of the Code shall be deemed to <br /> be incorporated in the Code, so that reference to the Code includes the additions and <br /> amendments. <br /> SECTION 6. That if any word, phrase, clause, sentence, or paragraph of the Code <br /> or this ordinance is held to be unconstitutional or invalid by a court of competent <br /> jurisdiction, the remaining provisions of the Code and this ordinance shall remain in effect <br /> as if the unconstitutional or invalid portion had not been adopted. <br /> SECTION 7. That all ordinances and resolutions or parts of ordinances or <br /> resolutions in conflict herewith are repealed. <br /> SECTION 8. That any person violating any provision of this ordinance shall be <br /> deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br /> provided in Section 1-5 of the San Marcos Code of Ordinances. <br /> SECTION 9- That this Ordinance shall be in effect ten days from and after its <br /> passage, and notice of its adoption shall be published in a newspaper of general circulation <br /> in the area as required by the Charter of the City of San Marcos, Texas. <br /> PASSED AND APPROVED on first reading January 8, 1996. <br /> PASSED AND APPROVED on second reading January 22, 1996. <br /> PASSED, APPROVED AND ADOPTED February 12, 1'996. <br /> l~rr~' ~ <br /> Mayor <br />
