That Section 2.021 of the San Marcos City Code is added to read as <br />u.()i '- "'" <br />~ ;:,follows: <br /> <br />Sec. 2.021. Evaluation of appointees by council. <br /> <br />The city council will perform an annual evaluation of the city manager, city <br />attorney, city secretary, and presiding judge of the munièipal court during the <br />first quarter of each city fiscal year. <br /> <br />SECTION 2. That Section 2.044 of the San Marcos City Code is added to read as <br />follows: <br /> <br />Sec. 2.044. Preparation of agenda. <br /> <br />(a) The city manager is responsible for processing and approving agenda materials <br />for city council meetings. The city manager will submit agenda materials as <br />appropriate for review by the city attorney and the director of finance. The city <br />secretary is responsible for preparing and posting the agenda and assembling and <br />distributing the agenda packets. <br /> <br />(b) The tentative agenda for each council meeting will be reviewed by the mayor <br />before finalization. <br /> <br />(c) The mayor and council members will provide direction to the staff on ordinance <br />revisions and similar matters of council policy only after discussion by the council <br />at council meetings or workshops. The mayor and any council member may <br />request a discussion item on an agenda for a council meeting or workshop. <br /> <br />SECTION 3. That if any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br />remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br />invalid portion had not been adopted. <br /> <br />SECTION 4. That all ordinances and resolutions or parts of ordinances or <br />resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 5. That any person violating any provision of this ordinance shall be <br />deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br />provided in Section 1.015 of the San Marcos City Code. <br /> <br />SECTION 6. That this Ordinance shall be in effect ten (10) days from and after its <br />passage, and it shall be published in a newspaper of general circulation in the area as <br />required by the Charter of the City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading January 22, 1996. <br />
