Þ <br />, --~ <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING THE ORDINANCE ADOPTED ON <br /> FEBRUARY 12, 1996 ORDERING A JOINT GENERAL AND SPECIAL <br /> ELECTION BY THE CITY AND THE SAN MARCOS CONSOLIDATED <br /> INDEPENDENT SCHOOL DISTRICT TO ADD CITY COUNCIL MEMBER, <br /> PLACE 5 TO THE BALLOT; AND DECLARING AN EMERGENCY. <br />r- <br /> RECITALS: <br /> 1. Billy Moore, City Council Member, Place 5, with a term of office to expire in <br /> May, 1997, has announced his candidacy for the office of Mayor. <br /> 2. Article 11, Section 11 of the Texas Constitution provides that if any member <br /> of the City Council announces candidacy for any office other than the office then held, at <br /> any time when the unexpired term of the office then held exceeds one year, the <br /> announcement constitutes an automatic resignation of the office then held, and the <br /> vacancy created shall be filled pursuant to law in the same manner as other vacancies for <br /> the office are filled. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: . <br /> SECTION 1. That Section 1 of the Ordinance adopted by the City Council on <br /> February 12, 1996 ordering a joint general and special election by the City and the San <br /> Marcos Consolidated School District for May 4, 1996 is amended by adding City Council <br /> Member, Place 5 to the ballot. <br /> SECTION 2. That if any word, phrase, clause, sentence, or paragraph of this <br /> ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br /> remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br /> invalid portion has not been adopted. <br /> SECTION 3. That the importance of this Ordinance creates an emergency and an <br /> imperative public necessity so that the provisions of the Charter requiring that ordinances <br /> shall be presented at three separate meetings and that no ordinance shall become <br /> effective until the expiration of ten (10) days following the date of its final passage be <br /> suspended, and these provisions are hereby suspended, and this Ordinance'shall take <br /> effect and be in full force and effect from and after its adoption and after its publication in <br /> a newspaper of general circulation within the City as provided by the City Charter of the <br /> City of San Marcos. <br /> ADOPTED this 2 day of ~.'íç. r c h ,1996. <br /> ~!~~, )~ <br /> Mayor <br /> di. ~ <br />\ ;., I tV#";" '}.I £.~ <br /> JanIs K.
