PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On January 23, 1996, the Planning and Zoning Commission of the City of San Marcos held a. public hearing regarding a request to change the zoning from "C" Commercial District to "MF-4" Multi-Family District (High Density) for a 10.5 acre tract of property located in the 100 Block of West Avenue. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on January 23, 1996, consider and vote to approve the request, and has recommended that the request be approved by the City Council of t~e City. . 3. The City Council held a public hearing on the 25th day of March , 1996, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code is amended to rezone the following real property which is presently zoned "C" Commercial District to "MFA" Multi-Family District (High Density): Street address: 1 00 block of West Avenue Size: 1 0.5 acres. Legal description: Lots 2, 3 and 4A, Block A, and Lots 3 and 4A, Block B, Westfield Addition. Deed or plat reference: Volume 3, pages 290-291; Volume 5, page 311 and Volume 6, page 42; all in the Hays County Plat Records. SECTION 2. That any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in Section 1.015 of the San Marcos City Code. SECTION 3. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice.
