'~ ~ ::; ~ <br />d~: - =¿z, :: <br />= ~.' .., 0 <br />~"..'D. ;.~ ~z.-- ORDINANCE1996- 22 <br />~.~ ~~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE ABANDONMENT OF A PORTION OF <br />HIGH STREET NORTHEAST OF ITS INTERSECTION WITH ALAMO <br />STREET; APPROVING THE SALE OF THIS RIGHT-OF-WAY TO JAIMY <br />BREIHAN; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; <br />AND DECLARING AN EMERGENCY. <br /> <br />RECITALS: <br /> <br />1. On February 13, 1996, the City Planning and Zoning Commission conducted <br />a public hearing on the proposed abandonment of 8,000 square feet of right-of-way of High <br />Street northeast of its intersection with Alamo Street, and voted unanimously to approve <br />the proposal. <br /> <br />2. The City has compiled with the requirements of Section 272.001 of the Texas <br />Local Government Code regarding the sale of property by a municipality. <br /> <br />3. The City has received an appraisal indicating the value of this segment of <br />right-of-way is $1,520. <br /> <br />~ <br /> <br />4. The owner of the property on one side of this segment, Jaimy Breihan, has <br />obtained the consent of the other abutting property owners to his purchase of the entire <br />area of the segment. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the abandonment of 8,000 square feet of right-of-way of High <br />Street described by metes and bounds on the Exhibit "A" of the deed attached to this <br />ordinance is approved. <br /> <br />SECTION 2. That the sale of the parcel of the right-of-way described above for <br />$1,520 to Jaimy Breihan is approved. <br /> <br />SECTION 3. That the City Manager, Larry D. Gilley, is authorized to execute the <br />Special Warranty Deed attached to this ordinance conveying to Jaimy Breihan the right- <br />of-way described above, subject to the reservation of a 15 foot wide public utility easement <br />along the northwest side of the property. <br /> <br />SECTION 4. That the importance of this Ordinance creates an emergency and an <br />imperative public necessity to that the provisions of the Charter requiring that ordinances <br />shall be presented at three separate meetings and that no ordinance shall become <br />effective until the expiration of ten (10) days following the date of its final passage be <br />suspended, and these provisions are hereby suspended, and this Ordinance shall take <br />effect and be in full force and effect from and after its adoption and after its publication in <br />a newspaper of general circulation within the City as provided by the City Charter of the <br />City of San Marcos. <br /> <br />PASSED, APPROVED AND ADOPTED this 25th day of March, 1996. <br /> <br />; ~ ~ - <br /> <br />Kathy M.
