On November 29, 1994, the Zoning Commission of the City of San Marcos held <br />a public hearing regarding a request to change the zoning from "M" Single-Family, Duplex <br />and Neighborhood Business District and "R-1" Single-Family Dwelling District (Low <br />Density) to "CIt Commercial District for a tract of property 1.58 acres, located at 1400 <br />Aquarena Springs Drive. <br /> <br />2. Subsequent to the public hearing on that date, the Zoning Commission did, on <br />November 29, 1994, consider the request and voted to approve and has recommended <br />that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 23rd day of <br />January , 1995, regarding the request. <br /> <br />4. All requirements of Appendix A, General Zoning Ordinance, of the Code of <br />Ordinances of the City of San Marcos pertaining to amendments have been met. <br /> <br />5. The City Council finds and determires that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official Zoning Map of the City, as described in Section 3 of <br />the General Zoning Ordinance, is amended to rezone the following real property which is <br />presently zoned "M" Single-Family, Duplex and Neighborhood Business District and "R-1" <br />Single-Family Dwelling District (Low Density) to "C" Commercial District: <br /> <br />Street address: 1400 Aquarena Springs Drive <br /> <br />Size: 1.58 acres. <br /> <br />Leqal description: See attached Exhibit A. <br /> <br />Deed or plat reference: In the process of being replatted. ' <br /> <br />SECTION 2. That this Ordinance shall be in ,effect ten (10) days from and after its <br />passage and after it has been subject to reconsideration by the Council at its next regular <br />meeting following its passage, and provided that the Council did not vote to reconsider it. <br />If reconsidered on Feb .13, iJt~1I be in effect ten days from and after its passage on <br />that date if approved. It shall not go into effect if denied., If not recönsidered and approved <br />it shall be published in a newspaper of general cirèulation in the area as required by the <br />Charter of the City of San Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this23r~ay ofJanuar,y1995, subject to <br />reconsideration at the next regular City Council meeting scheduled for Feb. 13 " 1995. <br />
