C1 ¢I <br />U <br />0 <br />6 <br />< <br />v� <br />;-- <br />(n <br />d" <br />cr <br />.-i <br />i� <br />M-1 <br />Ty <br />173 <br />ORDINANCE 1995- 10 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS UPDATING AND CLARIFYING <br />CHAPTER 12, GARBAGE AND RUBBISH, OF THE SAN <br />MARCOS CODE OF ORDINANCES; RETITLING THE <br />CHAPTER "SOLID WASTE AND RECYCLABLE' <br />MATERIALS"; INCLUDING PROCEDURAL PROVISIONS; <br />AND PROVIDING PENALTIES FOR VIOLATIONS. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. That Chapter 12, Garbage and Rubbish, of the San Marcos Code of <br />Ordinances is amended to read as follows: <br />CHAPTER 12 <br />SOLID WASTE AND RECYCLABLE MATERIALS <br />ARTICLE I. IN GENERAL <br />Sec. 12-1. Definitions. <br />In this Chapter: <br />(1) Bag means a plastic sack used to store garbage and rubbish. <br />(2) Bin means a metal receptacle used to store refuse, designed to be <br />lifted and emptied mechanically. <br />(3) Bulky waste includes appliances, furniture and other large waste <br />materials, other than construction debris, dead animals, hazardous <br />waste or stable matter. <br />(4) Construction debris means waste building materials resulting from <br />construction, remodeling, repair or demolition of buildings. <br />(5) Dead animal means any dead animal or part of an animal other than <br />those processed for human use. <br />(6) Garbage means decayable solid waste, including dead animals, <br />animal and vegetable waste, food containers, and all other waste <br />matter which is likely to attract flies or vermin. <br />(7) Garbage container means a plastic, metal or fiberglass receptacle <br />used to store garbage and rubbish. <br />(8) Hazardous waste means any chemical, compound, mixture, <br />substance or article designated as a "hazardous material" under state <br />or federal law. <br />(9) Recyclable materials means garbage or rubbish material that still has <br />useful physical or chemical properties after serving its original purpose <br />and that can be reused or remanufactured into other products. <br />(10) Recyclable materials container means a plastic receptacle used to <br />store recyclable materials. <br />(11) Residential unit means a room or set of rooms suitable for residential <br />use by a single family, including a single-family dwelling, townhouse, <br />apartment or condominium unit. <br />
