J _b q: ~D AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, UPDATING AND CLARIFYING CHAPTER 13, HEALTH AND SANITATION, OF THE SAN MARCOS CODE OF ORDINANCES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING PENALTIES FOR VIOLATIONS, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1, That Chapter 13, Health and Sanitation, of the San Marcos Code of Ordinances is amended to read as follows: ,', CHAPTER 13 HEAL TH AND SANITATION ARTICLE I. IN GENERAL Sec. 13-1. Definitions. . I In this chapter: (1) Brush means all trees and shrubs under 7 feet in height which are not cultivated and maintained. (2) Director means the director of the environmental health department, or the director's authorized representative. (3) Rubbish means garbage, trash, or other discarded personal property. (4) Stagnant water means water which stands upon a lot in a manner and for a period of time likely to create a breeding place for mosquitoes, (5) Lot means a tract of real property, (6) Weeds means grass and uncultivated vegetation other tharl trees and shrubs which exceeds 12 inches in height, or which is a breeding place or harborage for mosquitoes or vermin. Sec. 13-2 - 13-15. Reserved. ARTICLE II. MAINTENANCE OF LOTS Sec. 13-16. Prohibited conditions designated. It is unlawful for an owner of a lot to,cause or permit weeds, rubbish, brush or stagnant water to accumulate or remain on the lot. Sec. 13-17. Notice to correct prohibited conditions. (a) The director will provide notice to owners of lots found in violation of Section 13-16 that they must correct the prohibited conditions within 10 days of the notice.
