J _b <br />q: ~D <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, UPDATING AND CLARIFYING <br /> CHAPTER 13, HEALTH AND SANITATION, OF THE SAN <br /> MARCOS CODE OF ORDINANCES; INCLUDING <br /> PROCEDURAL PROVISIONS; AND PROVIDING PENALTIES <br /> FOR VIOLATIONS, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> SECTION 1, That Chapter 13, Health and Sanitation, of the San Marcos Code of <br /> Ordinances is amended to read as follows: <br /> ,', <br /> CHAPTER 13 <br /> HEAL TH AND SANITATION <br /> ARTICLE I. IN GENERAL <br /> Sec. 13-1. Definitions. <br /> . <br />I <br /> In this chapter: <br /> (1) Brush means all trees and shrubs under 7 feet in height which are not <br /> cultivated and maintained. <br /> (2) Director means the director of the environmental health department, <br /> or the director's authorized representative. <br /> (3) Rubbish means garbage, trash, or other discarded personal property. <br /> (4) Stagnant water means water which stands upon a lot in a manner and <br /> for a period of time likely to create a breeding place for mosquitoes, <br /> (5) Lot means a tract of real property, <br /> (6) Weeds means grass and uncultivated vegetation other tharl trees and <br /> shrubs which exceeds 12 inches in height, or which is a breeding <br /> place or harborage for mosquitoes or vermin. <br /> Sec. 13-2 - 13-15. Reserved. <br /> ARTICLE II. MAINTENANCE OF LOTS <br /> Sec. 13-16. Prohibited conditions designated. <br /> It is unlawful for an owner of a lot to,cause or permit weeds, rubbish, brush <br /> or stagnant water to accumulate or remain on the lot. <br /> Sec. 13-17. Notice to correct prohibited conditions. <br /> (a) The director will provide notice to owners of lots found in violation of <br /> Section 13-16 that they must correct the prohibited conditions within 10 days of <br /> the notice. <br /> (b) The director will give the notice: <br />
