'ð;ä <br />U-o .::::: u..I ø <br />_.~ ~ ~- <br />p ~ ~~ ORDINANCE 1995-~ <br /> ~ 6ø <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br /> MAP OF THE CITY BY REZONING A 3.072 ACRE TRACT <br /> OF PROPERTY, LOCATED AT 1637 POST ROAD FROM "C" <br /> COMMERCIAL DISTRICT TO "MF-4" MUL TI-FAMIL Y <br /> RESIDENTIAL DISTRICT (HIGH DENSITY) AND DECLARING' <br /> ._~ AN EFFECTIVE DATE. <br />; <br />I <br />, <br /> RECITALS: <br /> 1. On January 24, 1995 the Planning and Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the zoning from "C" <br /> Commercial District to "MF-4" Multi-Family Residential District (High Density) for a 3.072 <br /> acre tract of property located at 1637 Post Road. <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br /> Commission did, on January 24, 1995, consider and vote to approve the request and has <br /> recommended that the request be approved by the City Council of the City. <br /> 3. The City Council held a public hearing on the 27th day of <br /> February , 1995, regarding the request. ~ <br /> <br /> 4. All requirements of Appendix A, General Zoning Ordinance, of the Code of <br /> Ordinances of the City of San Marcos pertaining to amendments have been met. <br /> 5. The City Council finds and determines that the adoption of the following <br /> ordinance is in the interest of the public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />¡ TEXAS: <br /> SECTION 1. That the Official Zoning Map of the City, as described in Section 3 of <br /> the General Zoning Ordinance, is amended to rezone the following real property which is <br /> presently zoned "C" Commercial District to "MF-4" Multi-Family Residential District (High <br /> Density): <br /> Street address: 1637 Post Road <br /> Size: 3.072 acres. <br /> Leoal description: Lot 1 of LernMor Subdivision. <br /> <br /> Deed or plat reference: Volume 2, Page 389, Hays County Plat Records. <br /> <br /> SECTION 2. That this Ordinance shall be in effect ten (10) days from and after its <br /> passage and after it has been subjed to reconsideration by the Council at its next regular <br /> meeting following its passage, and provided thatthe Council did not vote to reconsider it. <br /> If reconsidered on 3/6/95 it shall be in effect ten days from and after its passage on <br /> that date if approved.. It shall not go into. effect if denied. If not reconsidered and approved <br />, it shall be published in a newspaper of general circulation in the area as required by the <br /> Charter of the City of San Marcos, Texas. <br /> PASSED, APPROVED AND ~DOPTED this 27tk.day of Feb. , 1995, subject to <br /> reconsiderati,on at the next regular, City Council meeting schedufed for March 6, .1995. <br /> Reconsidered ye~. no.X <br />
