<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE FUTURE LAND
<br />USE MAP OF THE MASTER PLAN OF THE CITY, FROM
<br />LOW DENSITY RESIDENTIAL AND HIGH DENSITY
<br />RESIDENTIAL TO PUBLIC FOR 9.42 ACRES OF
<br />PROPERTY LOCATED AT 2001 RIVER ROAD AND.
<br />DECLARING AN EFFECTIVE DATE.
<br />
<br />¡ WHEREAS, on October 26, 1993, the Joint Planning and Zoning
<br />, Commissions of the city of San Marcos held a public hearing
<br />regarding a request to amend the Future Land Use Map of the Master
<br />Plan from Low Density Residential and High Density Residential to
<br />Public for 9.42 acres of property located at 2001 River Road; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Commissions .did, on October 26, 1993, consider the request and
<br />voted to approve it and have recommended that the request be
<br />approved by the City Council of the City; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the day
<br />of , 1994, regarding the request; and,
<br />
<br />WHEREAS, all requirements of the Master Plan pertaining to
<br />amendments have been met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following resolution is in the interest of the
<br />public, health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />; PART 1. That the following described tract of real property
<br />. located at 2001 River Road, San Marcos, Hays County, Texas, which
<br />is in an area shown on the Future Land Use Map of the Master Plan
<br />of the city of San Marcos as Low Density Residential and High
<br />Density Residential shall be shown on that map as Public:
<br />
<br />9.42 acres of land out of the J.M. Veramendi Survey #2,
<br />Hays County, Texas, as described in a deed to Hill
<br />Country Faith. Ministries, Inc. from Theodore Breihan,
<br />said deed dated March 2, 1979, and recorded in Volume
<br />326, page 578, Hays County Deed Records.
<br />
<br />BEGINNING at a 60d nail found at base of corner fence
<br />post for an East corner of the tract herein described,
<br />same being a North corner of that tract of 0.5 acres of
<br />land conveyed to Sylvester Miranda, et ux, by R.L.
<br />Bunting by deed dated June 30, 1972, and recorded in
<br />Volume 192, page 274, Hays County Deed Records same being
<br />an East corner of the said Breihan "Tract One," and on a
<br />Southwest line of that tract of 5.5 acres of land
<br />conveyed to Edwin Mutschlechner, et ux, by Del vin J.
<br />simon, et ux, by deed dated November 20, 1954, and
<br />recorded in Volume 163, page 82, Hays County Deed
<br />Records;
<br />
<br />I THENCE, leaving the said Miranda. 0.5 acre tract, with a
<br />I Southwest line of the said Mutschlechner 5.5 acre tract,
<br />, same being a Northeast line of the said Breihan "Tract
<br />One," N 46° 59' W 685.97 feet to an iron stake set at
<br />base of corner fence post for the North corner of the
<br />tract herein described;
<br />
<br />THENCE leaving the Southwest line of the said
<br />Mutschlechner 5.5 acre tract, with fence, S 27° 28' W.
<br />714.59 feet to an iron stake set for the West corner of
<br />the tract herein described;
