<br />I ~7 <br /> <br /> <br /> <br />RESOLUTION 1994 - 18 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, DECLARING A CITY <br />BUILDING TO BE SURPLUS PROPERTY; AGREEING TO <br />DONATE THE BUILDING TO THE TEXAS HILL COUNTRY <br />BRANCH OF THE NAACP; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The city is the owner of a wood frame building (the <br />"Building") that was previously a part of the Dunbar School. <br /> <br />2. The Building is not needed by the City to serve_any present or <br />anticipated future municipal purpose. <br /> <br />3. A local' nonprofit human service agency has expressed an <br />interest in using the property upon which the Building is located. <br /> <br />4. The Texas Hill Country Branch of the National Association for <br />the Advancement of Colored People (the "NAACP") has expressed an <br />interest in having the Building donated to it so that the Building <br />can be rehabilitated for community service purposes in the Dunbar <br />neighborhood area of the City. . <br /> <br />5. The City is willing to donate the Building to the NAACP under <br />the terms contained in this resolution. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That the Building is declared to be surplus to <br />present and anticipated future needs of the city. <br /> <br />PART 2. That the City agrees to donate the Building to the <br />NAACP and to relocate the Building within 30 days to a site <br />selected by the NAACP in the Dunbar neighborhood area of the city, <br />subject to the following: <br /> <br />(a) The city will contribute $11,500 towards the costs <br />of connecting the Building to utilities at the new <br />site, and rehabilitating the Building. <br /> <br />(b) The NAACP will obtain all appropriate permits and <br />will comply with applicable construction ordinances <br />for moving and rehabilitating the Building. <br /> <br />(c) Upon completion of the rehabilitation, the NAACP <br />will use the building for community service <br />purposes, and will make programs, activities and <br />use of the building available to the public without <br />regard to race, creed, national origin, age, sex or <br />physical disability. <br /> <br />(d) Fees for all building construction permits will be <br />waived. <br /> <br />PART 3. That this Resolution is in full force and effect <br />immediately upon its passage. <br /> <br />ADOPTED this 24th day of Ja~~:œ~ ~ <br /> <br /> <br /> <br />Mayor <br />Attest: .
