<br /> , :& :a"'1 <br /> . ~ l';: I' 12 <br /> Q~ ~ <br /> !U~ .-- e3 <br /> ;.j'ò j'r ê3ã <br /> -~ (' l.t.Jø <br /> ~ <ZI- <br /> ~~ -< :>-° <br /> ::E t::b ORDINANCE 1994- 23 <br /> \ ~ <:.;IS <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br /> ZONING MAP OF THE CITY BY REZONING A 0.11 ACRE <br /> TRACT OF PROPERTY, LOCATED AT 301 ROOSEVELT <br /> STREET FROM "M" SINGLE-FAMILY, DUPLEX AND <br /> NEIGHBORHOOD BUSINESS DISTRICT AND "R-1" <br /> SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) <br /> TO "R-2" SINGLE-FAMILY DWELLING DISTRICT <br /> (MEDIUM DENSITY) AND DECLARING AN EFFECTIVE <br /> DATE. <br /> RECITALS: <br /> 1. On February 22,1994, the Zoning commission of the City of <br /> San Marcos held a public hearing regarding a request to change the <br /> zoning from ~;o "M" Single-Family, Duplex and Neighborhood Business <br /> District and "R-l" Single-Family Dwelling District (Low Density) to <br /> "R-2" Single-Family Dwelling District (Medium Density) for a 0.11 <br /> acre tract of property located at 301 Roosevelt Street. <br /> 2. Subsequent to the public hearing on that date, the Zoning <br /> commission did, on February 22, 1994 consider the request and voted <br /> to approve and has recommended that the request be Àpproved by the <br /> city Council of the city. <br /> 3. The city Council held a public hearing on the 11th day <br /> of April , 1994, regarding the request. <br /> 4. All requirements of Appendix A, General Zoning ordinance, <br /> of the Code of Ordinances of the City of San Marcos pertaining to <br /> amendments have been met. <br /> 5. The City Council hereby finds and determines that the <br /> adoption of the following ordinanc,e is in the interest of the <br /> public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That the Off icial Zoning Map of the city, as <br /> described in section 3 of the General Zoning Ordinance, is hereby <br /> amended to rezone the following real property which is presently <br /> zoned "M" Single-Family, Duplex and Neighborhood Business District <br /> and "R-l" Single-Family Dwelling District(Low Density) to "R-2" <br /> Single-Family Dwelling District (Medium Density): <br /> Street address: 301 Roosevelt Street <br /> Size: 0.11 acre <br /> Leqal description: Lots 14 and 15, Block 10, Victory <br /> Gardens Addition, section 1. <br /> Deed or plat reference: Volume 128, page 46, Hays County <br /> Deed Records. <br /> SECTION 2. That this Ordinance shall be in effect ten (10) <br /> days from and after its passage and after it has been subject to <br /> reconsideration by the Council at its next regular meeting <br /> following its passage, and provided that the Council did not vote <br /> to reconsider it. If reconsidered on April 25, 1994 it shall be <br /> in effect ten days from and after its passage on that date if <br /> approved. It shall not go into effect if denied. If not <br /> reconsidered and approved it shall be published in a newspaper of <br /> general circulation in the area as required by the Charter of the <br /> City of San Marcos, Texas. <br /> PASSED, APPROVED AND ADOPTED this 11th day of April , 1994, <br />
