RESOLUTION 2013 -07R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO APPLY FOR FUNDING FROM THE TEXAS DEPARTMENT OF TRANSPORTATION UNDER THE 2012 STATEWIDE TRANSPORTATION ENHANCEMENT PROGRAM FOR A NEW ADA COMPLIANT BICYCLE AND PEDESTRIAN PATHWAY ADJACENT TO THE SAN MARCOS RIVER CONNECTING THE SAN MARCOS VISITOR'S CENTER WITH THE PROPOSED TEXAS STATE UNIVERSITY -SAN MARCOS VISITOR'S CENTER HAVING AN ESTIMATED COST OF $2,564,232.00; APPROVING THE CITY'S EXPENDITURE OF LOCAL MATCHING FUNDS IN AN AMOUNT UP TO $650,000.00; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE ANY DOCUMENTS AND CONTRACTS AS NECESSARY TO ACCEPT AND IMPLEMENT THE AWARD OF FUNDS ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City of San Marcos seeks to develop a new ADA compliant bicycle and pedestrian pathway adjacent to the San Marcos River connecting the San Marcos Visitor's Center with the proposed Texas State University -San Marcos Visitor's Center having an estimated cost as shown in the nominating budget of $2,564,232.00. 2. The nominating entity, City of San Marcos, supports funding this project as shown in the nomination budget (including the 25 percent local match) and commits to the project's development, implementation, construction, maintenance, management, and financing. The nominating entity, City of San Marcos, is willing and able to enter into an agreement with TxDOT by resolution or ordinance should the project receive funding. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The City Manager or his designee is hereby authorized to apply for funding from the Texas Department of Transportation under the 2012 Statewide Transportation Enhancement Program for a new ADA compliant bicycle and pedestrian pathway adjacent to the San Marcos River connecting the San Marcos Visitor's Center with the proposed Texas State University -San Marcos Visitor's Center having an estimated cost of $2,564,232.00. PART 2. The expenditure of local matching funds in an amount up to $650,000.00 is hereby approved. PART 3. The City Manager is further authorized to execute any documents and contracts necessary to accept and implement the award of said funds on behalf of the City. PART 4. This Resolution shall be in full force and effect from and after its passage.
